We believe that all children have a right to protection from intentional or negligent harm by an adult under the law and that excusing any adult from such actions sets a very dangerous precedent for the State. It is absolutely unacceptable to cover up child abuse and neglect. We want to send a very strong message that we believe all children deserve protection under the law and medical treatment. We hope that you will help us to uphold these rights and seek justice for Qadira and all children.

On April 12th, 2007 Qadira Stephens (our daughter) became a victim of child abuse and neglect at the hands of Aimee McQuiston and Todd Burkholder. She was 8 years old. She was bathed without our permission and was severely burned with scalding hot water from a teapot during the bath and then wrapped in a towel and placed in their basement for an undisclosed amount of time. Todd Burkholder and Aimee McQuiston admitted to harming Qadira and admitted that they did not seek medical care for her after she was burned. They have taken zero responsibility for Qadira’s injury.

She was seen at Providence St. Vincent hospital the night she was injured and Oregon Health and Sciences University in the following days after she was injured. Each time we took her to the hospital she was released almost immediately in severe shock and unable to walk. We were repeatedly told by several different doctors that she was okay. The Police and DHS were not notified of her injuries. Qadira sustained burns on 10- 20 percent of her body and literally got no medical treatment. We were sent home alone with no appropriate supplies, medicine, instructions, or supervision of any kind. She eventually went into organ failure and almost died. She has suffered and she continues to suffer terribly due to the lack of hospitalization from her burn injury.

We hired the law firm of Vangelesti Kocher to represent Qadira in an action against Todd and Aimee’s homeowners insurance company State Farm and they also failed to report her abuse to the authorities or help Qadira in any manner. Scott Kocher and Richard Vangelesti violated all of her civil rights as a victim of child abuse and worked with State Farm Insurance Company, attorney Rudy Lachenmeier, Judge Michael McShane, and Judge Dale Koch to cover up this crime. I, Qadira’s mother, was illegally appointed her “Guardian ad litem” which is against State and Federal Laws.

Susan Glosser, a professor at Lewis and Clark College, was the presiding juror at an illegal and fraudulent civil proceeding held at the Multnomah County Courthouse that helped deliver a unanimous civil verdict in favor of Qadira’s abusers. This verdict awarded them court costs and attorney’s fees for abusing Qadira and helped further insulate them from criminal prosecution. Todd, Aimee, and the hospitals walked away with zero consequences. Vangelesti Kocher argued to the court, without my knowledge, that Qadira’s skin tone was an “infirm condition” and that was the sole reason she was permanently scarred from the burn injury. Qadira’s own attorney literally argued that Qadira’s skin tone was a disease.

We hired Attorney Andy Simrin to appeal this case in the Oregon Court of Appeals. He also failed to explain to us that this was a case of child abuse and child neglect and that her case should have never been filed in a civil court. The verdict was affirmed yet again by Oregon Appellate Court Judges Schuman, Wollheim, and Ellen Rosenblum (now Oregon’s Attorney General) without opinion. Qadira’s abusers once again were not held accountable and awarded even more costs. After that Andy Simrin refused to help us appeal that ruling. I, Qadira’s mother, asked the court to appoint Qadira counsel to petition the Supreme Court. This request was denied by Judge Rives Kistler. I, Qadira’s mother, personally wrote her petition to the Supreme Court myself and Chief Justice Paul J. De Muniz signed the order that declined to hear her case.

We have spoken to many attorneys in town and they have all refused to help Qadira. In doing our own investigation we discovered that Todd Burkholder’s brother, Rex Burkholder, is a prominent politician here in the State of Oregon. When we tried to file a police report after the fraudulent court proceeding we were adamantly told that we were not allowed to file a police report. My husband went down to the station with Qadira and they finally took a report but refused to investigate. Oregon DHS did a shallow investigation after receiving the police report, speaking only with our family and Qadira. They failed to investigate or interview her abusers, or their child who was a witness to the abuse, or the hospitals, or anyone else that was involved in the matter. I was personally told by Sergeant Dan Lieu of the Child Abuse Team that “the police do not investigate this type of thing.” The District Attorney refused to allow us to press charges without a police investigation. When I tried to obtain copies of the report I was denied access on the grounds that the report is exempt from public viewing because it “contains reports of child abuse.”

Dr. Julie Andrews of Providence St. Vincent’s hospital (the attending emergency physician who failed to treat Qadira on the night she was burned) and Dr. Sarah Tubbesing, Dr. Nacamuli, and many other doctors at Oregon Health and Sciences University, Portland Public Schools, and many judges, attorneys, elected officials, and corrupt law enforcement individuals have not explained their refusal to treat, report, or respond to Qadira’s injury. She is now 22 years old and lives with a host of compounding medical issues as a result of the non-treatment of her burn and has yet to receive any form of compensation or even an apology.

We filed pro se legal complaints against all of the doctors involved, OHSU, Providence St. Vincent’s, The Oregon Medical Board, Vangelesti Kocher, State Farm Insurance Company, Cares NW, The Portland Police Bureau, Portland Public Schools, DHS, The Oregon Department of Justice, and The Federal Bureau of investigation. We asked for counsel but were repeatedly denied. These complaints were dismissed with little to no explanation by Judge Adrienne Nelson, Judge David F. Rees, Judge Kelly Skye, and Judge Michael W. Mosman. We appealed these actions all the way up to the ninth circuit court of appeals and they were dismissed with little to no explanation upon arrival by Judge Goodwin, Judge Leavy, and Judge Silverman. The media has refused to cover this story.

The Portland Police Bureau, The Independent Police review, The Oregon Medical Board, the local FBI, The Oregon State Bar, the Judicial Review Board, The Oregon Department of Justice, and State and Local officials have been repeatedly informed of this matter and have refused to investigate or take any action on behalf of Qadira. No one has ever been investigated, charged, or prosecuted for what happened to Qadira.

We are asking the State of Oregon to stop engaging in racist and corrupt practices by stopping the cover up of abuse and neglect of our daughter. We are asking for a full and fair investigation from the proper authorities. We are asking that every individual involved in this crime and its cover up be held accountable. We must not allow this behavior to invade our public institutions and safeguard the protection of our children and every other citizen in this country. We are asking for Justice for Qadira!

A severe Unhealthy version of Feminist. The Man hating type, Dp 1000 things to you but if you say anything back you are targeted by her and her flying monkeys. CPS in THREE States now has been her flying monkeys… Even though the other two States caught her. Apologized and erased any file on me… I did nothing but, love them. After my kids were molested… By the way. I have zero founded anything from those states on me… She however had drugs, abandonment, neglect, abuse, molestation, a dirty home, no food, on and on. I’ve debated posting this out of FEAR of retaliation from CPS. My son posted that he is in 100% belief that CPS is trafficking his sister and fears he and his brother are next as well as peers. He is a hard nut to convince of things like this. He is a Boy Scout. He is a great kid as with all my children. I have raised them ALONE for over 10 years minus CPS involvement that I had ZERO to do with 24/7/365 parents. I do it all. Enough is enough already… I am a student/worker at UCC. All medical covered up to date. My kids are very involved in the community as I am. Finalist for Ford Foundation Single Parent $40,000 a year scholarship. This comes with the extreme background and reference checks as well as grades and community, volunteer service. I’m no slouch.

Especially considering the condition my children were returned to me, the issues they had to overcome, and the disabilities I have worked so hard to help them overcome. I meet all their needs besides having two healthy, functional, involved, trustworthy parents. Sadly they’ve only had me.
So, my kids SOMEONE else besides me, I will call just that. Someone. Someone last year made a false report. This is proven false, litigated in custody court, and over with. I already had custody but, Oregon needed it updated, DONE. Soul custody. SOMEONE was absent for over 10 years. Sever addictions, remarried, and homeless 8 most of it. hubby accused by CPS of Molesting my Daughter in California. I ALWAYS tried to keep communication up, access to the kids with supervision if needed, etc…
SOMEONE would NOT get a job, house, things needed to be there. NOT my problem. I tried helping too much until I stopped believing. Then, I focused on kids and School. NOTHING ELSE. So, SOMEONE gets an inheritance in 2019 and blows most of it, FINALLY gets a place in February of 2020. By March 3rd ONE of my THREE kids is TAKEN by CPS because SOMEONE took my kids to get braces with what little was left of that money. That and a down on a place. Coooool right???? Besides the TAKING part WRONG! It’s used to pull narcist moves and repeat past abuses unto us.

Past DOCUMENTED abuses to us and MANY. It isn’t easy to gain custody of your kids as a man… For me anyway. You encounter countless abuses and lies with no consequence but, you raise your voice out of sheer duress and the constant attacks, and POOF you are the loser. Baffled. Like, What? I yelled back after hours of it coming at me? Or Makes claims that they are taking your kid knowingly lying to do so and you but, don’t you dare say you’ll make em wish they didn’t… That’s a threat. NOT STEALING your child and Lying to do so. Which is Kidnapping. Trafficking. That’s not a threat. But, Saying you’ll sue them is? Backward as hell… AND HEN they claim you are kidnapping if you try to stop them… I personally have to fight every natural parent instinct in my body, mind, and soul not to drag them out into the street and force them to tell the truth as I beat their sorry arses but, I won’t go there in this story as some people get offended, like CPS WORKERS, by someone defending their kids from crooks. ALSO,,, CPS WORKERS backing up other ones is like a COP or CRIMINAL backing up their partner when they murder someone or sell dope themselves. SELLING KIDS. Geeeezus friggn hell.

I never went after the kids anyway. Ever. I always wanted co-parenting and fairness… No arguing in front of kids. All of it. I mean, I save things like
locks of hair, Tooth fairy stuff, awards, special cards, you name it. like a mom or grandma does. I cook daily. I do it all. For the record. Separated
since 2006. The year my daughter was born.

I had my daughter going to the dentist. Getting work done before the braces. I initially took them 2 years ago and couldn’t afford it yet. It was coming but, SOMEONE took them which I was happy about, even though I didn’t permit them. This is covered in the custody order from this last fall… The orthodontist put the braces in but, because the dental work, root canal, needed to be finished HE left the braces unfinished… It is bad enough she bit through her mouth twice from novocaine during the weekdays before the Friday she got the braces. I spoke of this, in poor baby talk, sharing with co-workers. Her brothers and SOMEONE was aware. Someone was supposed to take her to the dentist and didn’t take her to the last appointment even though it was agreed on. SO, Friday she gets braces. Goes to her Someone later that day after stopping home for me to see via Visitation…

It was my son’s Bday so they did a party while there.
Bowling party. I paid. She comes, they come home Sunday night. My daughter’s mouth all cut to pieces and hurt. I get her soft foods, wax, medicine, etc.

Monday I go to work. I tell my coworkers about it when asked how she is. I tell them she came home to cut up, poor baby, the orthodontist left a bar loose and it cut her. She was bending it out the way making it worse… STOP TOUCHING IT!! The boys see the blood. She tells everyone… So, it’s KNOWN WHat did it. Malpractice from refusing to WAIT for her dentist to finish the work…

That coming Wednesday, two days later, there is a card on my door… It’s from CPS. I call. The CPS Investigator says she has my kid. They already took her to SOMEONE’s house. She claims that I squeezed my daughter’s mouth so hard that it undid her braces and that she had horrific injuries from me. That my eyes turned BLACK (I wear glasses) I argued with my 14-year old for 45 minutes and tried to hit her and screamed the whole time making statements carefully placed to go with her VERY CREATIVE narrative. I mean, being generous, it was so CREATIVE that I am still upset and is laughable at best. 6 months and HELL later.

I tried to respond. I tried telling her that it was not true. She started yelling at me instantly as if she knew me and like I was a little kid or
even had a reason to lie. . I am in my forties. She threatened me that if I did not sign a 10 day that she would do court the next day. It was FINALS
week. Having had 5 terms straight of 4.0s GPA, I signed it so she “could investigate it and check my witnesses, custody Lawyer evidence, and whatever else. I was not worried. I already had texts, screenshots, witnesses, previous court and CPS from two other states that I was awarded the children AFTER their Someone caused involvement until caught making untrue statements, dirties, other REALLY BAD things to my kids from someone.

Every time started from a disorder that basically equals a habitual liar, narcissist, and Muenchausinish traits. My worry was only that my daughter had been being told things as with the boys that I also have the screenshots. Things like, Tell people your daddy hits you and I will pay you and him. Do it or else you won’t get your racecar grandpa left you. A Legit RACECAR. I only do drugs cause I lost you. Your dad took you. Your dad beat me up when we lived in Missouri. My son answered Our and Dad’s love isn’t for sale and a lot of grown-up things that were true of her. That he remembers it all and she’s lying, etc. My daughter was too young to remember most of it… The thing is. I NEVER lived there with her. None of it is true. I even have proof. I saved EVERYTHING since 2007 when her first, really first BIG flare-up started from Doctor Prescribed painkillers… I HATE pills. That kind anyway. After I saw what it did to her.BPA here in the Burg is who told me to start saving everything when I proved it then… Because her disorder is a doozy… Her 19-year-old BF tried to attack me and lost. No idea why. So, she had me arrested and claimed I robbed her and other things. The DA’s very own PIU found that they lied and charges were dropped. This was after a grand jury indictment. She put a restraining order from my kids. AND FROM my school. When she was caught she forced me to move to California where she’s from or she’d take the kids anyway. As I was saying, I did a 10 day so they could see. I understood that they heard something and thought it so I wanted to be reasonable plus had finals…

During the 10 days, she did nothing. I contacted my entire witness list. This is after coming home the 10th day and the INVESTIGATORS called and said I had court in an hour. I was like Huh? WHY? She said again that I did it and that she went to the orthodontist and that the orthodontist said that I did horrific injuries. Injuries are so bad that it took great force and such. She said like it was even humanly possible to do that (It isn’t. Not even close) it was the worse case she ever saw. Soap operas and theaters can’t get as dramatic as she played it to be. Then again when I tried to explain she got angry and rude and I was three again being scolded and told don’t argue just be there. I asked did she contact my lawyer and she said no. So, I go to court and she hands me the paperwork. Someone is there as well. Since last year when this all started, from false accusations made by someone that I have the screenshots of as well, someone has been manipulating my kids, trying to, to turn on me offering inheritance money and ZERO rules. Claiming abuse, blah blah, the same stuff she was caught making up in the past or variances of… I digitally have screenshots of her telling my daughter that she will come to get her because my daughter got grounded. My daughter had her Someone take her somewhere she was not supposed to go to and my daughter pretended I didn’t tell her several times NOPE. For good reason. It’s a friend of hers that I have to balance time or she gets too influenced and makes bad choices. She tends to imitate her and in reverse as well. Love her to death but, chemistry is chemistry. Especially at 14 years old. So, daughter says WHAT? CALL THE COPS Dad didn’t do anything to call a cop… SOMEONE says I’ll find a way and sneaks off with my daughter without telling me. Someone hides her for 45 days and calls
cps.

I called cops and cps too as the cop had me call cps. I had custody. They pretended it was controversial so, I refiled. Something SOMEONE could have done the last 10 years and never bothered. Maybe showed up twice a year. Some years a little more. Always marked on the arms or bruised up. Yelling. Starting fights. Telling the kids she’s on needles. In front of EVERYONE at my apartments. Embarrassing us. Etc. Threatening. Lying. On and On. Arrests, Black eyes.

Pissing off bikers and hiding here. Sleeping 3 days then bailing. Yeah. Rough stuff. So, court 5 minutes before court I am told my lawyer won’t be there because I was assigned a PD by them. My Lawyers Callender was full as well. So, I go to a room 5 minutes before the court. Getting rushed and told how bad it all looks on me, blah blah blah. Very Grimm. I was like wait What? I was reading the report to the Judge that Cps maid and has to hand me. MINUTES before the court. Remember I was told less than an hour before the court to be there now as my one of three children is being given to the person who the last order I had from cps was to KEEP THE kids away from Someone and Hubby. I have the records of Molestation, abandonment, drugs, daughter walking in hooker neighborhood, and returned by cops at 4 years old, etc. REALLY BAD STUFF. I got them back so damaged. The damage came from false info given to cps from this person that turned out untrue and an overdose with a letter as to why… Two Gals I Cali recommended the kids to me after years of Welfare, SSI and drugs, fraud. I had them. Someone else collected. Until I was driven out of desperately to feed
my children that I left with them to Missouri for a safe place following a safety plan.

SOMEONE hot-lined me from California as I was in Missouri and Made claims that later turned out to be untrue. This was 2 business days before the court in Cali that I was getting the kids. She filed that case. Not me.

So, Missouri did their tests. Found out there was no dope in my system and no non-accidental trauma to my middle child. He was knocked down by a dog when I was not there. At my brother’s house. Safehouse. Note: I have ALL OF THIS in documents AND CPS was given it as well… They left all of it out of their reports and stuck with a made-up story I have NO IDEA from where besides their imagination.

Also, SOmeone in this story refers to the kid’s other parent/guardian. So if it says, someone. It’s because I didn’t want to say her name.
This report said things in it that I was so shocked in disbelief that it was surreal times 1000… I am a proud daddy Momma. This report was so awful and ridiculous that it could only be made up. I’m not kidding. Written as if I were in a wonderland where everything is backward and NOTHING makes sense or adds up. I can’t stress this part enough. Since and NOT UNTIL SOMEONE got inheritance I was never outlined here. Same apartment for the last 7 years. Same neighbors. The hot-line people here all the time…I was not hot-lined by anyone here. Someone did it last year and was caught. Even CPS told my lawyer last year that my daughter was being coached. I also have texts on it. Screenshots to the boys too of it. It was hot-lined. Cps KNOWS. But, now is pretending they do not know. But, I have the email sent to them saying so and ALL I say right now with 100% proof. But, I was hot-lined since Someone came back from outer- space, still on needles the whole time, and 5 times since in less than a year. Oh, and the kicker. She was hot-lined BACK last year when it started. Before that, we were all happy and functional. They tested her as I reported her for parental kidnapping and dope. She was DIRTY. She drove off and had her on a very high number for Meth tests. I HAVE a copy from my Lawyer. This was hidden from me in fact, their report says Unfounded on her and that she’s been in a drug program… Also, untrue. She never went and was booted for non-attendance. Also, on file… The initial investigator last year made a report. It was correct somewhat for the other person. Completely made up on me. Mine was unfounded. It was for SAYING my kid had to do 1000 pushups and Kicking.

I kicked no one. There was no mark at all. and no one did 1000 pushups. Hyperbole. This was for my daughter to get grounded. The screenshots I spoke of earlier. The ones that say “she’ll find a way”… They were USE CPS like she tried in Missouri and succeeded. I never made it to either court. Not guilty didn’t matter. She got them. I got hit by a tornado. 24 broken bones and dislocations. They took them to Cali. 3 months later Cali took them from her for the things I mentioned. Missouri got them. Took them from her as well. They went to me with an apology and a safety plan. All I said was correct and proven. She has a disorder that makes her this way. Drugs make it better actually but, only the illegal ones. Had I known last year when CPS got involved she WAS DIRTY, I wouldn’t have BEGGED her to at least take a graduated visit plan, she wasn’t even going to show in court. She was afraid she owes 30G in back support and the court would find she’s hiding money, inheritance, etc, and lied to the court. I BEGGED so my daughter would not think it my fault.

The boys had enough over the years. The daughter was too young to remember the super-bad days. Stories she used to tell. Especially the BAD BAD she blacked out or pretends happened. But, the CARES center did forensic interviews. All kid’s stories were the same. Daddy is good. Someone, not so much. Also, someone told the daughter to lie according to the interview. Also, someone was feeding the false history that only the daughter believed. She thinks she’s saving someone from drugs by being there and that dad did bad things he never did. I have proof. But, 14 is 14. Easily manipulated. Targeted. She never took to someone until her rival brother quit trying to make someone love and be good for him. So, yeah Last year. Fake call just like Montana, Missouri RUINED my family. CPS there made the call and I never saw my other son again. I raised him most of his life. My kids never knew life without him. Now it’s happening to sister. Someone helped make my oldest disappear when Missouri happened. I miss him so much. As I do my daughter. I have been healing them from that and now Oregon CPS wants to pretend that CPS Missouri’s mistake never happened and the Damage CPS did there is my fault here. WTF? Remember, I have the papers showing all of what I say, So, SOmeone and CPS destroy our family., arrogantly so. Viscous and controlling over easily checked things, as if MONEY and NOT Child protection is their goal.

Because Missouri was a 2.5-year ordeal that was only a visit to stay safe and kids fed for a month and destroyed the body and my business. Made me an FT single papa. With nothing. Sleeping on the ground. I worked up to this. The kids are, were 1000 times better. So, CPS Oregon steps in. See’s the Missouri reports. and decides to make up a story told, I assume, by this Someone I speak of and put it down in report #1 last year. NOW, whats CRAAAZY is in the report, not only is it made up, but it says things about SOMEONE like this person is Manipulative and Meth, blah blah blah, This was a phone interview with the A caseworker from 2010-2013. The caseworker who caught SOMEONE claiming kids, stealing welfare, SSI, setting me up by leaving kids with me 24/7 for 9 months straight, popped all my tires, and every time I’d try to get food stamps, I had a job but, they were babies so I was on leave with no choice or sitter. I ate at food banks if the kids had food left. They always ate until full… I starved. That’s why I ran to Missouri. I was so hungry. Every month SOMEONE would send new papers to her mom and hen mom mailed it to DHS locally to look legit, Id hit the first and the card would be zero.

I have 9 months of paperwork proving it. STILL. Her suicide note admitted it. That’s why the GALs recommended the kids to me. The Caseworker apologized to me. Claimed we fell through the cracks. Made me do an appeal so they could make my end go away as I did nothing wrong and had no way of being in 2 courts in two states at the same time. My only fault was not being two people. SO, I learned o be MamaDa. TWO IN ONE..haha The same worker who said she always knew the truth which pisses me off. THEN WHY NOT RETURN MY KID? RULES PROCEDURES for MONEY. BS. Kids come first. Unless its CPS. It’s different if they traumatize and illegally
take your kid by lying. That’s different? That’s worse than their accusations!
Now, back to court. In this report, the INVESTIGATOR claimed to the Judge that I lived there with SOMEONE… NOPE NEVER. and also took the report from last year. The one about SOMEONE being Very Manipulative and Dirty for Meth, neglectful, etc….

SHE ERASED SOMEONE’s name from it and replaced it with mine…
I have BOTH documents. The original and the Court supplied. SHE FALSIFIED it. I am a Cyber Security major. I AM A SCIENTIST. AN INVESTIGATOR… NOWHERE in her report was anything scientific. An investigation is 100% scientific. It’s all made up or opinion. I have ALL the oppositional paperwork and witnesses on top to say and prove it false. Besides that. MY boys are here. They remember it all. They can tell you as well as reports I have that are official documents. I complained to supervisors. Very nice. Very calm. They start yelling and get MAJOR attitudes. I had to ask the second one WHY ARE YOU YELLING A ME? I work at UCC. I am not used to this kind of unprofessional treatment. hey NEVER answered me, got back to me, or let me know ANYTHING. They
never even let me tell them what was happening in my life.

So, that day of course COVID started, and my court date was pushed back. hen again because of a Psych Eval that was not in yet. The thing about this Psych Eval is, in Missouri, I learned that these are TRICKS by CPS to Medically kidnap your child. In Missouri, I took one from CPS but, another on the side. The one I paid for was NORMAL. I took theirs. After three days of it, all my tests were great, BUT… BUT, the Psych started ragging HARD on me. I was lost for a minute until he tells me that CPS and SOMEONE gave him collateral info beforehand. This means they Talked to him about me. So, the Psych was told BS and did his eval on their merits. Not mine. at was off. They also did one on my AUTISTIC son. Claimed he was not Autistic. That he had PTSD from me.

Oregon Health University diagnosed him several times as Autistic years before. CPS in Missouri did him for 2.5 years.., Then they got the records
and were like Oh well. They treated an Autistic kid for PTSD instead of Autism for 2.5 years. HE IS AUTISTIC. THEY paid for it too. They do it to
cheat… SO, I was told by my Lawyer we had it all beat because I did ZERO wrong. We had a meeting waiting for JURISDICTION court. FEM meeting. We ALL AGREED I would have access to the counselor or Psych Eval person if it came to that. THIS WAS A lI as well. They took my daughter. Gave the Psych they hired to come down from PORTLAND all of the false info I already proved wrong including false info on my daughters past and info I proved otherwise and PI reports showed as well and they Got a recommendation that my daughter has NO CONTACT from me because some Psychologists they fed lies to said so. I call this FAKE PSYCHOLOGY. It’s a dirty trick. My Lawyer, Public Defender they assigned says: You are going to be mad but, they did what they said they weren’t and it’s impossible to win in court now on ONE accusation.

SO, they come to my house saying I did something. I prove I didn’t. I prove it all wrong. I show that there is a long consistent pattern from SOMEONE and severe coaching with screenshots validating the claims. These screenshots show for the last year CPS has been working with SOMEONE to pull this off. It started in custody court last Fall when SOMEONE lost and was hiding my daughter against Judge’s order. A CPS Worker, Jessica said in court “Don’t worry we’ll find another way to get him and that Men shouldn’t raise kids. Especially girls… WTF. Someone has only been in their lives since January of this year…

So, my daughters Psych Eval says ALL NONSENSE. I have a lot of Psychology, Sociology. Child development and other credits. I worked At Charter School as well as an Aid. I am 100% positive (I get A’s on most of my finals.. Usually 100%s) so I KNOW for a fact it’s 100% wrong… Then there are the other Hot-lines made all year… They were so stupid and made up and from a counselor, I NEVER HIRED and gave NO permission for her to see. They tried saying she’s 14 now so she can but, avoid my complaint that it started when she was 13 against my wishes as she HAD a counselor already… This lady works for Compass. She hot-lined me three times… I NEVER MET HER. I DO NOT KNOW HER. SHE NEVER CALLED ME about anything… One hot-line was for My Daughter getting caught at midnight on her phone and it was taken. She went to school tired and told this lady it was because I kept her up… NO. I had homework… I went to pee. She got caught. Didn’t want to go to school. I made her anyway. SO WHAT. Another hot-line was for bitching them out at School for hot-lining me instead of CALLING me to see WHY my kid was tired… The Worker claims COMPASS, Freemont (All my kids went) and the Orthodontist all recommend my kid stays away… But, the boys are fine here??? I called and went to them all… The orthodontist I only FB’d. They ALL deny it. They all say the investigator made it up as they don’t give recommendations. The Orthodontist said he never said anything in the court report that it claims he said… NOT ONLY THAT but, CPS in Missouri wrote me emails. I know the caseworker… She told me she NEVER spoke to CPS here. She also said I was none of the things they claim.. She said it sounds like SOMEONE is at it AGAIN because it’s identical predatory tricks as she pulled on MO and CA.

So, CPS made it all up, and then, even though their story was proven wrong they proceed anyway. Even lying to the Judge claiming I refused to talk to them and all my concerns were invalid.. basically dodged his questions…
The reason we spoke to the judge is AFTER CPS lied and put false info in all their reports… I mean it’s ALL fake. NONE of it’s true… They took a
narcissist who CPS caught in Missouri and switched it to helping her screw me with what she was caught doing in Missouri… I Wrote some mouthy stuff on MY FB page NOT to them. They got it because SOMEONE got into my Page, she was blocked, and because I called them Nazi Bitches and some other TRUE statements.

Said I’d get back for the lies… This was a threat… YOU TOOK MY KID AND LIED to do it. That’s worse than a threat and I only threatened LAWSUIT…
SO, CPS RETALIATES for this and a complaint of discrimination to the Governor’s office. They show up… Ask about it. I tell them WHAT it means as to not be misconstrued and what this was because if you are a worker and LIE to steel custody it’s CHILD TRAFFICKING and against the law… Especially knowing all the molestation and abuse in the CPS/Foster system.

They took the boys for one day. Because of the post… Claimed it was because I was going to double murder my boys and then kill myself…? The Lady KNEW it was bs. The cop even did… She SMILED as she did it. Told my son he’d go to Prison if he ran and She would personally see to it…
The judge didn’t let that happen. They thought I fired my lawyer already and it was a sure shot in.

My daughter started seeing SOMEONE. At her house, the daughter starts acting crazy… Hitting screaming cussing etc… The boys and friends told me.. SOMEONE told her to do it here because she never has… So, daughter gets mad because I made my Son a Birthday dinner in her Birth Month??? She goes off for 30 minutes. THEN, tries to kick and hit me. I didn’t hit I only grabbed her face and said stop it!! My daughters’ mouth was sore from braces being not done right… She jerks away.. She tells me why. I say, “OH BABY I FORGOT about your new braces.” It only hurt cause her mouth was already sore… I felt bad but, She was verbally assaulting me, slamming doors, hitting me, etc for quite a while… I coulda called Juvi. But, it’s my kid so no.

So, that’s it. That’s ALL I did… I called SOMEONE right after. Said if she’s going to be back in their lives CO PARENT. This happened from her
parallel parenting. This was one of MANY problems, not even courts could stop her from this in the past… 12 years absent, she jumps in throwing me under the bus in court. Even though her texts to me, saved and all I claimed so far is, she didn’t want them. SHE said so…
She had a charge too. Not protecting my daughter from me??? I’ve been separated since 2006 from her… HOW could she be charged with that? She was not here. People were here. I have witnessed it. But, even though she texted my son that she knows I didn’t hit or do anything and it was my daughter… That the Investigator said she thinks it has to be for a reason that I got blamed so if she says guilty she gets guaranteed, my daughter… Even though SHE KNOWS I did zero wrong.

I have not seen my daughter who I raised most of her life single-handedly in OVER SIX MONTHS or talked to her… CPS says even though I did NOT do WHAT they claimed. The reason they took her… That they are still pursuing anyway. They also founded past reports that were unfounded and against me murdering the boys…???? CRAZY… They said this investigator and the caseworker are both NEW there… WTF??? NO, Looks and feels like a SETUP. Just like Missouri. They knew too… Go figure. It’s why I am NOT having it here. We are past this and I am not letting these kids go backwards. My daughter has already been abused, neglected, and around Meth since in CPS/Someone care. RIGHT NOW.

You WOULD THINK that CPS would be ecstatic that I was 100% correct in ALL I said and proved it and as I said HAPPY that I did NOT do what they thought… Happy that it was a mistake right?? WRONG! They are PISSED that they are wrong. Doing all they can to cover I up and hide evidence otherwise from the Judge. The PD that I fired told me::: None of my paperwork, witnesses, any of it that PROVES they are wrong is allowed and HE isn’t allowed to tell the Judge that Documents and stories are changing. Being manipulated to look like they are REAL. They even saw the letters from CPS Missouri saying it is incorrect and that they lied about her speaking. She can’t see the files, they were sealed, because I did nothing wrong. It was erased… Yet, They are in there using made up files against me and erasing SOMEONE’s name and putting MY NAME in its place!!!
I called them, on my FB, feminist Nazi Bitches. THIS IS WHAT REALLY PISSED THEM OFF… I only said it because it was an all-female team, unfounded all SOMEONE’s reports like testing dirty was and no matter what I prove, I still am wrong. Also, the lies they wrote and from the fact the day the FAKE ACTRESS INVESTIGATOR Claimed my FB Post that they are not even friends w/me on FB and it wasn’t to them nor said anything like this next doozy but, she claimed I was going to Kill my 2 kids and then myself… SO, for that and other lies and pretending with a cop there that she didn’t see the proof and WE all knew including the cop otherwise. He told her FREEDOM of Speech. She wanted me arrested… Still don’t know WHY? But, I called her a LIAR… She said, Sir. I have an ENTIRE TEAM to your NOTHING… Next, Popped out so quickly from my mouth… “Oh Yeah.. It takes you a whole team to lie?'” The cop laughed for like 10 minutes. Pissed her off worse. The NEW caseworker, remember this hasn’t even been decided that they have Jurisdiction and they don’t. They are lying and cheating my family to trick a judge and I am not cool with this. I am a GREAT DAD/Mom… For many years… Because they knew they would lose… Which should make them happy. They used this time/covid dates stretched out to make NEW accusations… Such as I am CRAZY…. Too Crazy to be a dad… I have been in the same place for 7 years. Kids were doing fine until CPS and SOMEONE started in last year…
My PD said The Physical and Emotional abuse charges and Mental Health charge, are all easily beaten. I proved it to CPS yet the charges still pend??? NO… Then the Newest.. the 4th… The SURE SHOT… This is the Psych Report on my daughter. My daughter who had no previous psych issues all of a sudden does… My lawyer said BOTH SIDES use this guy. Whoever hires him first usually gets the recommendation they want… So CPS gets him. Gives him false evidence to get the recommendation they want and then make the charge that I have a deterioration of the relationship with my daughter… WHAT? We have always been close. This was the first time EVER she screamed, cussed me out, or struck at me… She does it at her SOmeones since she came back into her life but, never here… So CPS puts her at SOMEONE’S house… BTW I have tons of texts/screenshots of MASS neglect and Abuse and Drug fights and running away sleeping in a park, etc… Since CPS put her there including attacking my other son and Gaslighting him, admitting their plan and trying to brainwash him too…
I was told by the caseworker that CPS did not intend to keep my child with her someone because of all the dirties and neglect just like the other states. All she does is fight with her someone over Meth… My Lawyer said my kid was articulate and bright… I was like NO SHIT? I raised her, duh. My daughter has a rivalry with her bubba, a BFF that constantly makes things up about her dad and plays both sides.. they brag here and call the mom and dad stupid… My son said he’d claim he’d run away if they took him and he did when they tried. My daughter, a 14-year-old typical kid, mimicked them and what lies she was told she retold as well. SAME stories. This is all documented. Reported. CARES did forensic interviews last year/.ALL the kids said Mom said to lie because she owed child support from 10 years of absence. On purpose, CPS even reported this… So, NOW the FAKE investigator claims There’s a reason why my daughter is saving face and doing this??? YEAH… It’s ALREADY IN YOUR REPORTS!!! SO, my PD said it’s now unwinnable because they cheated with the fake evaluation ploy… Earlier I mentioned my son with Autism… They pulled the same thing with my daughter. She has PTSD and SHE DOES NOT. From WHAT? EVERYTHING they said was proven wrong..

So, you try to talk to them. They just say WE”LL SEE IN COURT… BUT, COURT IS FIXED.. They cheated and made fake documents and then used those docs to say they had reports of it etc… NONE of it is remotely close to true…
Lastly … the Counselor… Last year, the daughter was kidnapped. Mom found with her on Meth, CPS takes her to this SECRET counselor… Who all year long sees me kid and makes reports… Example… I took the kids and my daughters BFF to Magic Mountain, Knotts, Newport Beach, Balboa Island, Stayed at a TEACHERS house. a lot more for Christmas Vacation. Hollywood too. Star walk and Sign. I was So sore I thought I’d die. lol In this so-called counselor report it says my kid was worried about going and having arguments with another family from the past… WHAT FAMILY??? Untrue. When before she claimed there was less arguing then now she thought… She and her BFF I paid for are the ONLY ones who argued. LOL, Every report like that… Or another… My kid said horrible things about California and ME… I was not there with her… She was with Mom and Molester who molested her then… She was molested by her Someone hubby and SOMEONE covered for hubby and threw my baby girl under the bus like she has the boys and me now and a million times before…

CHECK THE STUPID DATA TIMES… CALL THE PARENT, meeting and ask WHY she’s tired… He Hot-lined me for telling him to quit hot-lining me for nonsense. I am a student and work at a school. I don’t have time for those games. I have injuries. In my BIONIC hand as well. I cant squeeze 1/100th of the force they think I can… It’s impossible to squeeze someone’s face and UNDO their braces!!! ESPECIALLY with my hand with PLATES in it!!!

Our scout leaders work at CPS and own a kid’s store… They see the kids all the time. The YMCA daily back then before COVID, schools mandatory reporters all the time. NEVER AN ISSUE… The investigator reopened a 6-month-old case of my kid on her phone and founded it as MENTAL ABUSE against me????? DISCRIMINATION is so bad it’s crazy… They told me HUSH or it will get worse… NO, I will not. I will stand up for my kids. The last CPS order was from Missouri that I KEEP THEM FROM HER AND HER PET CHOMO.

The day I fired my lawyer he said that my kid wants to live at her SOMEONES… I was like, SO, who asked her?? I always told her the Judge decides. No law here for that,. We just SETTLED in the fall. So Fall, someone does not want them. I beg someone to at least to a graduated plan to get off drug and get Borderline personality meds, regulate, work up to it…. She did.. A big lie (German: große Lüge) is a propaganda technique. The expression was coined by Adolf Hitler, when he dictated his 1925 book Mein Kampf, about the use of a lie so “colossal” that no one would believe that someone “could have the impudence to distort the truth so infamously”. The source of the big lie technique is this passage, taken from Chapter 10 of James Murphy’s translation of Mein Kampf (the quote is one paragraph in Murphy’s translation and the German original):
But it remained for the Jews, with their unqualified capacity for falsehood, and their fighting comrades, the Marxists, to impute responsibility for the downfall precisely to the man who alone had shown a superhuman will and energy in his effort to prevent the catastrophe which he had foreseen and to save the nation from that hour of complete overthrow and shame. By placing responsibility for the loss of the world war on the shoulders of Ludendorff they took away the weapon of moral right from the only adversary dangerous enough to be likely to succeed in bringing the betrayers of the Fatherland to Justice.
All this was inspired by the principle—which is quite true within itself—that in the big lie there is always a certain force of credibility; because the broad masses of a nation are always more easily corrupted in the deeper strata of their emotional nature than consciously or voluntarily; and thus in the primitive simplicity of their minds they more readily fall victims to the big lie than the small lie, since they themselves often tell small lies in little matters but would be ashamed to resort to large-scale falsehoods.

Though the following supposed quotation of Joseph Goebbels has been repeated in numerous books and articles and on thousands of web pages, none of them has cited a primary source. Thus its attribution to anyone must be considered dubious. According to the research and reasoning of Randall Bytwerk, it is an unlikely thing for Goebbels to have said.[2]
If you tell a lie big enough and keep repeating it, people will eventually come to believe it. The lie can be maintained only for such time as the State can shield the people from the political, economic, and/or military consequences of the lie. It thus becomes vitally important for the State to use all of its powers to repress dissent, for the truth is the mortal enemy of the lie, and thus by extension, the truth is the greatest enemy of the State.
It is verified that Goebbels did put forth a theory that has come to be more commonly associated with the expression “big lie”. Goebbels wrote the following paragraph in an article dated 12 January 1941, 16 years after Hitler’s first use of the phrase. The article, titled Aus Churchills Lügenfabrik (English: “From Churchill’s Lie Factory”) was published in Die Zeit ohne Beispiel.

My belief is now this… If you lie to take a kid. I don’t care about you at all. And how they follow the DSM. It’s so flawed on purpose to get their clients to return. None of the Meds, well MOST of the meds are not real. Not placebo but, not real. They do not work. My experience with this system recently is from a grandmother’s point of view.

On May the 6th 2020, my 2 and a half-month-old granddaughter was taken to Stayton hospital by my daughter-in-law and my mother for what we thought was a dislocated arm after my daughter-in-law accidentally rolled over on her. Upon evaluation at the hospital, it was determined to be broken and she had multiple other fractures throughout her body with no known cause and no outward signs of trauma or injury. My daughter-in-law started making false claims of my son being too rough with his daughter due to nerve damage in his hands this is all false accusations. My granddaughter was transported to Portland to the children’s hospital for further examination. On May 7th CPS and the Stayon police showed up to the hospital they removed my son from the hospital put a 10- day protective order in place and said he could have no contact with his daughter. They then allowed my granddaughter to be taken to Texas with my daughter-in-law’s grandmother who had never even met her. It should be noted the grandmother is a doctor and has Multiple Sclerosis herself and she is 75 years old.

CPS never spoke with any of the family that lives locally before allowing this to happen. The medical records and testing that was completed here repeatedly show the reasoning for further genetic testing but yet no further testing has been completed sense being in Texas to our knowledge. My daughter-in-law and her family insist this is abuse without evidence. They claim she has had no further fractures so that proves it was abuse but in fact, that does not prove this. This proves to me they are using special care because they know she has fragile bones. But when she was here my son and daughter-in-law were caring for her like a normal baby because they did not know anything was wrong with her. Also, my daughter-in-law is no longer co-sleeping with her and rolling over on her like she has done before multiple times with witness accounts that CPS and the police have failed to take statements from.

No case has been filed in the juvenile courts. CPS claimed they completed an investigation and have founded the case against my son.

My son hired a medical expert witness to review the medical records he had access to and they gave a preliminary diagnosis of infantile hypophosphatasia otherwise known as Soft Bone Disease. My son is continuing to fight because no one seems to be listening.

My granddaughter needs medical treatment and CPS, Stayton police, and Marion County sheriffs have all played a role in stalling her access to medical care. My granddaughter is still in Texas. My daughter-in-law and her family want to keep her there so they are doing everything they can to block us from having any further testing completed. This is wrong and my granddaughter’s long-term health is what is at risk here.

My son filed a complaint with the Governors Advocate office that did nothing to help. My son filed a complaint against the officer who started the investigation at the Stayton police office that has done nothing. This entire case has not been handled properly. It has been a one-sided, narrow-minded sham. My son has a clean record never been in trouble or even suspended from school. He still has not been arrested, charged, or convicted of any crime yet he is being treated as if he is a criminal for something that is not even a crime. This has all been twisted and lies spun for my daughter-in-law and her family to gain custody of my granddaughter.

My granddaughter was not abused she has a potentially fatal condition that she needs treatment for.

Please help. Please bring change to this very broken system. Families should not be destroyed by lies and manipulations of a corrupt government system like CPS. We are still considering suing the state of Oregon. We are also considering going to the news and papers to bring awareness to this injustice.

An audit released by the secretary of state Jan. 31 reveals an overloaded child welfare system with a culture of bullying and intimidation.

Leaders of Oregon’s child welfare system have continually failed to fix systemic problems after paying $39 million in legal settlements, according to a new audit by the Oregon Secretary of State’s Office.

At the same time, child welfare employees have worked in a culture of bullying and intimidation, facing verbal abuse from Department of Human Services leaders, state auditors said in the report released Wednesday.

Some DHS staff members also were told not to talk with Secretary of State officials for the audit, according to the audit report.

“This sounds like a really poisonous atmosphere to work in,” said Jim Moore, director of the Tom McCall Center for Policy Innovation at Pacific University in Forest Grove.

“It sounds like an agency that is hunkering down and stonewalling,” Moore said. Moreover, it’s requiring employees to do the same, he said.

Secretary of State auditors also found:

• DHS has spent $39 million on legal payouts since 2006 because the agency couldn’t “consistently keep children in their care safe from abuse and neglect.”
• Agency leaders haven’t reversed high staff turnover and caseload rates that put children in danger.
• Agency managers have not addressed recruitment and retention of high-quality foster parents.

“To begin reversing the growing foster care crisis, we concluded DHS must first address its management and organizational cultural deficiencies,” the auditors said.

DHS agreed with the two dozen recommendations made in the report.

“When I started in my role as DHS director in September, the governor made it clear to me that she expects every child in foster care to be safe,” DHS Director Fariborz Pakseresht said in a statement.

“As part of that, she has directed us to focus on recruiting and retaining foster parents and caseworkers and to create a better culture of support for them,” he said. “She expects results and outcomes, and we will be reporting to her on those monthly.” 

In a statement, Gov. Brown said the monthly reports from Pakseresht will be made public once she gets them.

“As a state, there is so much more we can do to improve how the foster care system recruits and supports our frontline caseworkers and foster families,” Brown said. “To make sure our children get the best care possible, we need community support around foster families and case workers, from the simplest of donations to becoming a foster parent.”

Slow to respond

Agency leaders’ responses to more than a decade of scrutiny and crisis has been slow, indecisive and inadequate, auditors said. Efforts to reform the system have fallen flat because of poor planning, poor execution and eventual abandonment. Get the Daily Briefing newsletter in your inbox.

An example cited in the report was a 2016 mandate to complete more child abuse and neglect investigations in a timely manner. The Legislature was told the agency had made improvements completing the investigations, but the auditors found “the push to complete investigations lasted about three months, after which the agency’s complete rate returned to previous levels.”

“Field staff reported the use of questionable management tactics to push staff to complete more investigations, including threatening to take away scheduled leave time or put staff on administrative leave.”

DHS oversees about 7,600 children in foster care day-to-day.

The Secretary of State’s Office called for major reforms within the agency, saying DHS should set caps on how many cases staff members can take on and “cultivate a culture of transparency, responsibility, respectful communication and professionalism.”

“As a foster parent myself who adopted one of my daughters out of the system, I find the audit report results especially infuriating,” Secretary of State Dennis Richardson said in a press release.Buy Photo

“I believe how we treat our children reflects our heart and priorities as a state — and this report reveals that genuine introspection as a state is long overdue,” Richardson said.

Pakseresht said in a letter provided with the audit that child welfare director Marilyn Jones is poised to create new “Child Welfare leadership teams” that “will understand the need for transparency, strong and open communication, and offering high levels of support while asking for high levels of accountability.”

The agency agreed to work with the Legislature to add more staff members to address high caseloads, Pakseresht said in the letter.

Moore said the audit will likely shift top state lawmakers’ focus back to the state child welfare system, even during the short February session. Lawmakers will want to address the problems and hear from agency leaders, he said.

‘Bullying, intimidation’ in child welfare

Child welfare workers told auditors about multiple instances “of bullying, intimidation (sic) of caseworkers by senior staff and management efforts to suppress information.”

State auditors described a culture within DHS that has seen workers at the agency’s central office in Salem face “bullying in meetings, including being shouted at and verbally abused.”

“Some told us that they had been instructed not to talk to the state audit team,” auditors said.

One manager told auditors they were warned they would lose their job if they testified before state lawmakers about a program that was failing.

Another worker was directed by management to tell a lawmaker that information they asked for was not available “when it was,” auditors said.

“A third manager told us that they and their team were treated ‘as saboteurs’ for sharing information about a child safety review with management and that the report was essentially dismissed and ignored,” auditors said.

High caseloads still a problem

In Salem, child protective services workers are assigned 21 investigations monthly, more than triple the number of investigations they should be working on, based on an agency workload model, auditors said. They should have about seven investigations each.

In Prineville, permanency workers reported having to work up to 45 cases when staff levels were low. That’s almost quadruple a recommended 11.5-cases-per-person workload, auditors said. Roseburg permanency workers said they had about 20 cases each.

Permanency workers develop a plan for foster children to move to a permanent living situation, whether that’s adoption, living with a guardianship or reunifying with their birth family, according to DHS spokespeople.

“Caseworkers and other field staff told us repeatedly that the demands placed upon them were unrealistic,” auditors said.

In addition, DHS managers in Salem don’t accurately keep tabs on staff caseloads, auditors said. “This lack of oversight contributes to high caseloads that are not reflected in the available data and inequitable staffing levels between counties and districts.”

To conduct the review, auditors interviewed about 240 people, from agency leaders to staff members in the field. Auditors also sent out a 60-item questionnaire to district managers throughout Oregon.

The politics

The audit immediately entered the realm of politics Wednesday, with state officials using it to say their opponents weren’t doing their jobs.

Rep. Knute Buehler, a Bend Republican hoping to unseat Brown in the November election, laid the blame at the feet of the governor.

“Oregon’s foster care crisis is a failure of this government and this governor to protect and care for some of the most vulnerable children among us. It is a shameful violation of the public trust,” Buehler said in a statement.

“Rather than putting this issue at the top of the agenda for the upcoming legislative session, the governor continues to posture and position for her political base by pursuing misplaced priorities.”

Meanwhile, Chris Pair, spokesman for the governor, sent the Statesman Journal an email accusing Richardson, a Republican, of playing politics to advance his and his allies’ agenda.

“Gov. Brown already identified these issues and has been working with the Legislature to build the child welfare system our children deserve,” Pair said. “That’s why DHS was already working on 17 of the secretary’s recommendations before they were ever written.”

“Secretary Richardson’s audits are just about politics,” Pair said. “He should be working to help Gov. Brown ensure that our state’s limited resources are spent well on our shared priorities.”

SALEM — Gov. Kate Brown issued an executive order Thursday morning laying out a path for her to take a direct role in day-to-day operations at the state’s embattled child welfare program.

Under the executive order, Brown will lead a new oversight board that will meet at least every other week to decide what the child welfare agency should do. And she will install an on-site crisis management team to ensure Department of Human Services Director Fariborz Pakseresht and Child Welfare Director Marilyn Jones implement the panel’s recommendations. Brown will also embed one of her senior advisers at the child welfare agency to oversee the work, her order says.

“I’m hoping with this level of oversight we can continue to make progress and ensure our children are safe,” Brown said.

The governor announced the strategy two days after a national child advocacy group filed a federal lawsuit on behalf of 10 children in Oregon foster care and a week after lawmakers questioned the state’s decision to send one of those children – a 9-year-old girl – to a facility in Montana that used physical restraints and Benadryl injections to control her.

In recent months, news reports have revealed Oregon child welfare leaders have increasingly housed foster children in institutions, including sending them to out-of-state programs accused of abuse and placing them at residential programs in converted juvenile jails. A legislative hearing on child welfare officials’ use of foster programs in converted juvenile jails is scheduled for Thursday.

Oregon sends hundreds of foster kids to former jails, institutions, not families

A year ago, Oregon child welfare leaders signed a court settlement promising to stop housing vulnerable foster children in hotels, state offices and juvenile detention centers instead of with families. Since the settlement, the state has placed dramatically more children and teens in institutional settings including repurposed juvenile jails.

Dawn Post, deputy director of the group A Better Childhood which filed the federal lawsuit along with Disability Rights Oregon, acknowledged the governor’s action in a message on social media Thursday. “We are pleased that the state appears to be beginning to treat the care system as being in the crisis it is and we look forward to keeping the pressure on the state to ensure that the state, through whatever means, finally stops hurting children,” Post wrote on Twitter. At the same time, Oregon House Republicans said in a press release that Brown had more than enough time to identify problems and start implementing changes in the state’s child welfare program. “Another board won’t do,” they wrote in a press release.

Under Pakseresht, the agency has ignored reporting deadlines spelled out in state law and failed to disclose the deaths of several children killed after the case workers received or investigated reports or abuse, as The Oregonian/OregonLive first reported in November.

A proposal now working its way through the statehouse seeks to impose stricter rules on when and how the agency must disclose those deaths.

Buried: The state hides how children die on Oregon’s watch

Officials are supposed to review the deaths of children on the state’s radar to help prevent more kids from dying. But for more than a year, the state has delayed or withheld those reports from public disclosure.

The agency has also failed to accurately communicate and, Brown’s order says, to comply with the state’s public records laws. In response to questions about specific cases, the agency gave false information to The Oregonian/OregonLive in December. Its statements asserted the agency had no responsibility to publicly disclose any missteps that may have proceeded the deaths of two children, including the shooting death of a foster child in her foster home by another foster child.

In March, accurate information about the agency’s responsibility to investigate and report on the deaths became public after The Oregonian/OregonLive received public documents that contradicted what the agency said months earlier. Agency officials then acknowledged they had given out false information.

State hides from public more deaths of children on its watch as lawmakers plan reforms

The agency acknowledged Tuesday that it had incorrectly failed to disclose that it was reviewing its actions before the deaths of two children killed in 2017.

The governor’s recommendation for a crisis management team is reminiscent of an idea pitched by her Republican opponent in the 2018 election, then-Rep. Knute Buehler. In February 2018, Buehler called for the Legislature to appropriate an additional $50 million to address child welfare problems and bring in a “rapid improvement team.” At Brown’s request, the Legislature boosted child welfare spending by $14.5 million but no crisis management team was hired.

The executive order highlights the importance of child welfare leaders complying with Oregon public records law and the statutory mandate to review all abuse and neglect deaths of children in state care or who were on child protective services’ radar.

Brown’s administration has already taken a hands-on approach to the handling of public records and information releases at the Department of Human Services.

In 2018, the governor’s spokespeople routinely made the final call on whether the child welfare program should release even basic information such as the number of children in the system. Brown said her communication staff’s micromanagement of DHS information releases was intended to ensure the agency responded “expeditiously” on public records and information requests. Correspondence between the governor’s team and child welfare officials, obtained by The Oregonian/OregonLive, showed no evidence to support the claim this sped up responses.

On Thursday, Brown said she recently grew concerned “about information coming to my office, frankly, and to the public, making sure that information (on child welfare) was accurate about both individual cases and systems issues.”

Brown has been working to fix deep-seated problems in the state’s foster care system since she took office in 2015, but the lawsuit and latest revelations about the state’s questionable decisions suggest her attempts at reform have not stuck.

In a statement Thursday, Brown said, “Oregon’s child welfare system is overburdened to the point where I have serious concerns about the state’s ability to sufficiently serve our most vulnerable children. While DHS is working on long-term solutions to right-size the foster care system, there needs to be immediate action to protect children in care today. That’s why today I am … bringing in additional resources and expertise.”

In recent years Brown has:

· Commissioned an independent report, delivered in 2016 on the problems and solutions underlying Oregon’s foster crisis

· Appointed an advisory committee to oversee that report

· Required the Department of Human Services to submit monthly updates to her

· Hand-picked two different men to lead the Department of Human Services, one of whom — Clyde Saiki — retired less than two years into the job.

Brown notes in the order that the agency’s strict compliance with certain rules and practices is hindering its ability to hire and procure services necessary to make improvements in a timely manner, and she says the foster care crisis justifies bypassing some of those regulations. The executive order currently is set to remain in place for six months but Brown could extend it further.

ROSEBURG — A move to improve the care of foster children relegated to living in hotels has resulted in 25 percent more children removed from their families being housed in institutions such as former juvenile jails, The Oregonian/OregonLive has found.

The children being sent to cinderblock facilities are often the most traumatized and difficult to care for. Most are teens but the state is looking at expanding institutional programs for children as young as six.

A year ago, Oregon child welfare leaders signed a court settlement promising to stop housing vulnerable foster children in hotels, state offices and juvenile detention centers instead of with families.

State caseworkers had increasingly relied on those makeshift methods as Oregon faced a shortage of foster homes, particularly ones equipped to care for children grappling with trauma, mental health challenges or developmental disabilities.

One year after the settlement, child welfare officials say they’ve complied and begun phasing out their use of hotel rooms as temporary homes for children in the state’s care. On any given day in December, three foster children were spending the night in hotels, compared to 15 in February 2018.

But over the same time period, the state has placed dramatically more children and teens in institutional settings including repurposed juvenile jails. Since July 2018, the state has had around 400 foster children assigned to live in such settings, according to state figures. In September 2016, when two foster children and their advocates sued the state over its use of hotels, the number was close to 300.

Critics question whether former jails are the right place for foster children. And for many, such placements mean moving far from their home communities, switching to unfamiliar and sometimes segregated foster-child-only schools and losing the chance to live in the care of a parent figure instead of a rotation of shift workers.

When news first broke of children staying in hotels in 2016, state officials attributed the phenomenon to a shortage of foster parents.

But Oregon child welfare director Marilyn Jones, who was hired in 2017, now takes the position that recruiting more foster families is not the solution and increased institutional care is necessary.

“We don’t have … foster families that can meet the high trauma that these children have,” Jones told The Oregonian/OregonLive in a Feb. 25 interview. “They can be suicidal and homicidal. They can have self-harm or have harmed others.”

The Department of Human Services did not respond by Thursday to a request for the minimum age of foster children housed in institutional settings.

In Douglas County, Juvenile Department director Aric Fromdahl says his staffers have done what they can to turn one of the two “pods” in their detention center — a grey cinderblock building designed as a youth jail with an enclosed exercise yard — into a welcoming space.

“It’s not the softest building, but we do our best,” Fromdahl said during a tour of the facility in January.

For a 15-year-old girl from Multnomah County assigned to the facility last summer, the program in Roseburg, 180 miles from her home, felt both jail-like and remote.

“’She feels extremely isolated from her family. They are at least three hours away,” the girl’s court-appointed attorney, Lauren Freeman, said during a court hearing in Portland in August. “She feels, in essence, incarcerated … I had the same feeling when I was there. It feels as though it’s a converted jail facility.”

After talking with the girl and hearing from lawyers for her mother, the Sauk-Suiattle Indian Tribe in Washington and the Oregon Department of Human Services, Multnomah County Circuit Court Judge Katherine Tennyson ultimately ruled the facility was an appropriate place for the girl to remain at that time. The state’s attorney pointed to an assessment by the Douglas County facility’s staff that it was the correct placement for the girl. Lawyers for her mother and tribe agreed, with the mother’s lawyer stating that the mother wanted her daughter in a facility where she would not run away.

Sen. Sara Gelser, D-Corvallis, who has been a vocal advocate for improving Oregon’s foster care system, said she doesn’t want any foster child to get the message they are being punished or are unworthy of living in a family. Gelser said she has not visited the county juvenile detention centers where the state is sending children in foster care. “But if it feels like a jail, I just worry about who we’re telling these kids that they are … The bottom line is we need to be developing the right places for kids.”

Douglas County has housed foster children at other facilities for years. But last summer, Fromdahl said, Douglas County opened half of its juvenile jail to children “who are being diverted from hotels” in order to help the state comply with the settlement.

Teens from around the state stay at Douglas County’s new River Rock program, including eight from Multnomah County from July through January — one-third of the 25 teenagers in the facility during that time. The 13– through 17-year-olds spent two weeks to more than six months living in the cinderblock group quarters, according to information provided by the county.

In addition to the eight beds in the revamped juvenile detention wing, Douglas County operates a 16-bed facility for girls in Roseburg’s former police station and a 16-bed facility for boys in a group home building. Douglas County’s 40 beds for foster children mean it is now Oregon’s second-largest group care provider for children in the foster system, state records show.

The largest is St. Mary’s Home for Boys in Beaverton, founded 130 years ago as an orphanage for abandoned and wayward boys, where as many as 42 boys were assigned to live by the state at any given time over the past six months, according to state records.

Multnomah, Klamath and Josephine counties also have residential programs for teenagers from the foster system in repurposed wings of their juvenile jails. Unlike private programs, they are not licensed because under Oregon law the state lacks the authority to regulate county-run care operations. A proposal in the Legislature, Senate Bill 181, would change that. It would hold the county programs to the same standard of child abuse and neglect currently applied to other types of programs. And, by licensing county facilities, it would give the state another tool to force improvements.

Institutionalized Oregon foster children also live in a Grants Pass group home for 12 boys, a psychiatric residential treatment facility and related facilities in Utah, a group home for 14 boys in Salem and scores of other non-home placements.

Nationally, the movement in child welfare is away from caring for children in institutional settings, which research has shown yields poorer outcomes for kids than living with families. It was codified in 2018 in the Family First Prevention Services Act championed by Oregon’s U.S. Sen. Ron Wyden, which aims to provide families with services to help them keep their children at home and reduces states’ use of low-quality group homes.

In a statement to The Oregonian/OregonLive, Wyden said that his law is built around the “accepted principle that families are usually best-suited to prevent trauma for children and to reduce the need for foster care.”

“Family First provides both the structure and funding to focus on those proven prevention strategies and not unnecessary and non-therapeutic institutional care,” Wyden said. “Oregon has the opportunity to show leadership in this area, and I expect the state will become a full partner in taking advantage of this new law aimed at providing each child a safe, caring, and loving environment.”

Gelser, the state senator, leads a work group overseeing state’s implementation of the federal law. “It’s about making sure that kids who are vulnerable and have experienced trauma are receiving services in the highest quality, most appropriate and trauma-informed placements that are family-like,” Gelser said during a meeting last year. Under Family First, children should only be placed in institutional settings with more than four children “when it’s absolutely necessary and demonstrated by an assessment,” Gelser said.

Yet at a September legislative hearing, Jones, the child welfare director, said the hoteling lawsuit highlighted the state’s need for more institutional placements for foster children.

“We are the lowest in the nation in congregate care at 4.5 percent residential or treatment facilities for kids,” Jones said, citing a Casey Family Programs comparison using figures from 2016. “We have kids with high needs. We don’t have the capacity to really serve those high needs for these kids.”

As of September, Oregon had placed 5.4 percent of its foster children in group or institutional facilities, according to child welfare data. The national average in 2016 was 12 percent.

Diverting children who might end up in hotels to institutional settings is likely saving the state money. The cost to house a child in a hotel room averages $2,180, according to a child welfare spokesman. Most of the cost is to pay overtime to the two state workers who must stay with the child at all times. State auditors previously estimated that the Department of Human Services the cost was closer to $1,350 per day.

The state pays Douglas County $352 per day for each child who stays at the River Rock “intensive behavioral support” program, in the repurposed juvenile detention wing. A “short-term stabilization” program for girls run by the Klamath County Juvenile Department and the St. Mary’s Home for Boys that offers “intensive rehabilitation services” both charge $248 per child per day, according to the Department of Human Services. The agency pays $330 per day to four affiliated programs in Utah, including a psychiatric residential treatment center, to care for Oregon children.

In contrast, the state pays $182 per day to a therapeutic foster care program, Oregon Community Programs in Eugene. The rate covers not only payments to the foster families who typically care for a single child, but also the cost of support from agency staff who hold weekly meetings with foster parents, make a weekly plan for each child and are available for foster parents to reach out to 24 hours a day.

In addition to the lower cost, experts including Casey Family Programs say foster parents with extra training and supports, not county programs and other institutional homes, are the best care Oregon can provide to meet the needs of many children traumatized by family drama and separation, showing extreme behaviors or suffering from anxiety or other mental health conditions.

Instead, child welfare officials have been sending an increasing number of children who might otherwise be housed in hotels to institutions including locked out-of-state residential treatment facilities, as OPB reported earlier this year. The number of foster children sent out of state reached 82 last year and at least one of the facilities — Clarinda Academy — has been accused of abuse by whom Disability Rights Washington, according to OPB.

The no-hotels settlement was supposed to get more children and teens who’ve been removed from their families into the family-like settings that experts and Oregon’s foster children’s bill of rights say gives them the best chance to flourish. The plaintiffs wanted to minimize the chances that children in the state’s care would be cut off from their communities, schools and mental health providers.

Moving from one region to another can interrupt or delay mental health care for foster children, who are typically covered by Medicaid. The 15-year-old girl from Multnomah County who was moved to the Douglas County residential facility, for example, was enthusiastically participating in equine therapy before she was moved. Fromdahl, the Douglas County juvenile department director, said there is a roughly month-long delay to arrange healthcare such as therapy appointments once a child arrives in Roseburg because the child must be reassigned from one “coordinated care organization,” which manages care for Medicaid enrollees, to another.

Teenagers at Douglas County’s highest-level treatment facility, in the detention building, receive two hours of one-on-one counseling per week from staff who have some type of social services bachelor’s degree. They also participate in a couple hours per week of activities focused on building skills such as anger management and impulse control, which can be led by any program employee if it is designed by counselors, said Treatment Manager Sarah Wickersham. Youth who need alcohol or drug treatment go to appointments at an outpatient program.

Klamath County has taken a similar tack, turning one of its two juvenile detention center “pods” into a “Youth Inspiration Program” for girls in the foster system. It serves girls in the Oregon Youth Authority’s custody for committing crimes in the same pod. Douglas and Klamath counties’ facilities are not locked, but staff monitor the exits and intervene if a child tries to leave. Gov. Kate Brown wants the state to borrow $12 million to help Klamath County construct a separate building for the Youth Inspiration Program facility, according to her budget proposal.

Dan Golden, director of the Klamath County Juvenile Department, said the program has space for nine teenage girls but the governors’ proposal would allow it to grow to serve 24 girls, with half of the beds available to girls in the foster system. Both foster children and girls in custody for committing crimes receive addiction treatment and daily counseling from a local health care provider, Klamath Basin Behavioral Health.

Golden said many of the girls in the 90-day program have been sex trafficked. “So this is a much more secure surrounding to ensure security for these clients and make sure that people aren’t able to just enter the facility,” Golden said. He said that actually happened one time, when a couple of men who had trafficked one of the teens drove down from Portland in an unsuccessful attempt to get her out of the facility.

During the September legislative hearing, Jones, the child welfare director, told lawmakers the state is working to increase the supply of institutional care for foster children of all ages.

“We will have an additional 64 … beds across the state which will serve our littles, who are kids 5 to 8; our middles, who are 9 to 13; and our children that are — we call them our bigs that are 14 to 20,” Jones said.

Douglas County plans to help serve those “littles” with a 25-bed facility now being renovated that will house children ages 6 to 12.

Ana Day, executive director of Oregon Community Programs which coordinates a network of therapeutic foster families in Eugene, said the state needs a range of programs for children including some residential treatment facilities. But she emphasized that many children with serious behavioral issues, including self-harm, can succeed in foster homes when the families have enough support and are able to focus on a single foster child with his or her own room.

The prospect of placing more young children in institutional care is troubling, she said. “It should be the absolute exception to have a 6-year-old in residential care,” Day said. The challenge, she said, is “the truth is there’s not enough foster families” trained and willing to provide the expert support some very young children need to succeed.

Day pointed out that as Oregon leaders work on adding capacity to the child welfare system, their decisions today will determine the types and quality of care available to children for years to come.

“Oregon doesn’t have the resources for all of these kids,” Day said. “And if they’re going to build them, it would be smart to think about how do you build the ones that are right for those kids and not just the ones that are right for today.”

Audit critical of child welfare system

SALEM, Ore. — Leaders of Oregon’s child welfare system have continually failed to fix systemic problems after paying $39 million in legal settlements, according to a new audit by the Oregon Secretary of State’s Office.

At the same time, child welfare employees have worked in a culture of bullying and intimidation, facing verbal abuse from Department of Human Services leaders, state auditors said in the report released Wednesday.

Some DHS staff members also were told not to talk with Secretary of State officials for the audit, according to the audit report.

“This sounds like a really poisonous atmosphere to work in,” said Jim Moore, director of the Tom McCall Center for Policy Innovation at Pacific University in Forest Grove.

“It sounds like an agency that is hunkering down and stonewalling,” Moore said. Moreover, it’s requiring employees to do the same, he said.

Secretary of State auditors also found:

• DHS has spent $39 million on legal payouts since 2006 because the agency couldn’t “consistently keep children in their care safe from abuse and neglect.”
• Agency leaders haven’t reversed high staff turnover and caseload rates that put children in danger.
• Agency managers have not addressed recruitment and retention of high-quality foster parents.

“To begin reversing the growing foster care crisis, we concluded DHS must first address its management and organizational cultural deficiencies,” the auditors said.

DHS agreed with the two dozen recommendations made in the report.

“When I started in my role as DHS director in September, the governor made it clear to me that she expects every child in foster care to be safe,” DHS Director Fariborz Pakseresht said in a statement.

“As part of that, she has directed us to focus on recruiting and retaining foster parents and caseworkers and to create a better culture of support for them,” he said. “She expects results and outcomes and we will be reporting to her on those monthly.”

Slow to respond

Agency leaders’ responses to more than a decade of scrutiny and crisis has been slow, indecisive and inadequate, auditors said. Efforts to reform the system have fallen flat because of poor planning, poor execution and eventual abandonment.

An example cited in the report was a 2016 mandate to complete more child abuse and neglect investigations in a timely manner. The Legislature was told the agency had made improvements completing the investigations, but the auditors found “the push to complete investigations lasted about three months, after which the agency’s complete rate returned to previous levels.”

“Field staff reported the use of questionable management tactics to push staff to complete more investigations, including threatening to take away scheduled leave time or put staff on administrative leave.”

DHS oversees about 7,800 children in foster care.

The Secretary of State’s Office called for major reforms within the agency, saying DHS should set caps on how many cases staff members can take on and “cultivate a culture of transparency, responsibility, respectful communication and professionalism.”

“As a foster parent myself who adopted one of my daughters out of the system, I find the audit report results especially infuriating,” Secretary of State Dennis Richardson said in a press release.

“I believe how we treat our children reflects our heart and priorities as a state — and this report reveals that genuine introspection as a state is long overdue,” Richardson said.

Pakseresht said in a letter provided with the audit that child welfare director Marilyn Jones is poised to create new “Child Welfare leadership teams” that “will understand the need for transparency, strong and open communication, and offering high levels of support while asking for high levels of accountability.”

The agency agreed to work with the Legislature to add more staff members to address high caseloads, Pakseresht said in the letter.

Moore said the audit will likely shift top state lawmakers’ focus back to the state child welfare system, even during the short February session. Lawmakers will want to address the problems and hear from agency leaders, he said.

‘Bullying, intimidation’ in child welfare

Child welfare workers told auditors about multiple instances “of bullying, intimidation (sic) of caseworkers by senior staff, and management efforts to suppress information.”

State auditors described a culture within DHS that has seen workers at the agency’s central office in Salem face “bullying in meetings, including being shouted at and verbally abused.”

“Some told us that they had been instructed not to talk to the state audit team,” auditors said.

One manager told auditors they were warned they would lose their job if they testified before state lawmakers about a program that was failing.

Another worker was directed by management to tell a lawmaker that information they asked for was not available, “when it was,” auditors said.

“A third manager told us that they and their team were treated ‘as saboteurs’ for sharing information about a child safety review with management and that the report was essentially dismissed and ignored,” auditors said.

High caseloads still a problem

In Salem, child protective services workers are assigned 21 investigations monthly, more than triple the number of investigations they should be working on, based on an agency workload model, auditors said. They should have about seven investigations each.

In Prineville, permanency workers reported having to work up to 45 cases when staff levels were low. That’s almost quadruple a recommended 11.5-cases-per-person workload, auditors said. Roseburg permanency workers said they had about 20 cases each.

Permanency workers develop a plan for foster children to move to a permanent living situation, whether that’s adoption, living with a guardianship or reunifying with their birth family, according to DHS spokespeople.

“Caseworkers and other field staff told us repeatedly that the demands placed upon them were unrealistic,” auditors said.

In addition, DHS managers in Salem don’t accurately keep tabs on staff caseloads, auditors said. “This lack of oversight contributes to high caseloads that are not reflected in the available data, and inequitable staffing levels between counties and districts.”

To conduct the review, auditors interviewed about 240 people, from agency leaders to staff members in the field. Auditors also sent out a 60-item questionnaire to district managers throughout Oregon.
