Caseworker Lacks Field Knowledge, Professionalism or Ethics!

Mother and 1 yr old daughter staying at a shelter for victims of domestic abuse, in the height of the pandemic and restrictions.
Mother is involved with treatment for alcohol abuse, and has been sober since February 2020 (minor incident and reported to her mentors).
Waiting for funding for domestic violence housing, they had no where else to go. Family lives out of state, no friends that had room and no vehicle.
Mother was also waiting for restrictions to lift so that she’ll be able to have an extensive surgery (total abdominal reconstruction) to repair a life threatening hernia. This condition is a result of a domestic violence (father of child) and police brutality that happened not even a year ago.
As part of the agreement to staying with the shelter, UA and breathalyzer tests would be administered randomly or when suspected of using.
Mother has had false positive UA in the past (3) and with further clinical tests they are determined that it was due to her prescribed medication and was negative.
Mother communicated everything to the shelter staff, and list of Dr note and med list.
With the mothers past, and trauma she was experiencing some PTSD, along with severe abdominal pain (can’t use the bathroom) and was emotional the past few days. Felt like a failure to be living in a shelter while raising her very active toddler (who was the only baby in shelter). With no toys, tv, food (convenient for baby needs), on lock down, and at a social distance where no one is allowed to help or play with child.
On May 13th she was asked to provide a UA and breathalyzer, on suspicion that she had been drinking. The staff said that she was moving slower, and slurred her words. Mom and baby just got up from a afternoon nap, and she explained to staff that she had taken some medicine (RX) that made her feel drowsy and showed the bottle, that’s why she waited until her daughter nap time so that they could sleep together.
Mother did the breathalyzer right away and was negative. But just had used the bathroom so the UA wasn’t done until around 745 pm that night.
Willingly she provided a sample, and the test wasn’t done in front of her, or shown the results, and only 1 staff member was present. The staff member said to the mother “uh oh! Looks like you’re in trouble!”
“What do you mean?” Mother replied.
“You tested positive for Amphetamines, meth, benzodiazepines, MDMA and opioids.”
Mother is confused!! She hasn’t done any street drugs, let alone never has done MDMA ever in her life! There had to be an explanation, or a another test to do.
They made the report that night, without retesting it sending the sample to a clinic.
Following afternoon, mother starts to worry cause no one has come to talk to her. She asked a shelter staff member if she can retest?! Or to see the results! And even ask for her own sample back. They informed her that’s not their policy, and it was thrown out.
Moments later at lunch time, daughter and mother were interviewed by Nicole Tyma. Who had “accidentally” called mother asking for father minutes prior.
Locked in a room with Nicole Tyma, she explained everything and demanded to be taken to the emergency room for blood testing, and was rudely denied with a smile and laughter. Nicole argues with mother telling her she’s on drugs (when she wasn’t). Lying to the mother by telling her if she had somewhere to go to provided shelter for her toddler, she could go.
Nicole Tyma contacted the child’s father, and waited until the mother had some family friends on their way before telling her.
Without mothers consent to a protective action plan with the father, Nicole informs mother that he is there and that this is happening. Nicole takes the child by stroller, without mother’s consent! Also police were in the facility.
Left with no resources, or correct and full contact information and false promises of the child returning. Expecting the mother to do the impossible in 10 DAYS especially during a pandemic and her life threatening condition!
The mother was already involved with mentors, counseling, rehab, and witnesses. She went to her primary care physician and had a proper drug assessment, and was proved to be clean, and even went as far as switching medications!! With very little time and money mother was determined and secured a 2 bedroom apartment (with no job, criminal charges, limited vacancies due to covid)
Frantically the mother tries to keep Nicole Tyma updated, without any communication from her. Mother reaches out to Nicole supervisor Kentara Parker, who was also lied to from Nicole.
Nicole Tyma also kept the child’s father informed, with frequent communication through text messages. Nicole instructing the father to Pursue a immediate danger order from court! On May 28th Nicole reassures the father that mother will be found for neglect and abuse via text. (The father was so kind enough to show the mother during a visitation )
Nicole Tyma, did not call the mothers advocates, she did NOT conduct a through investigation, she did NOT follow the law undue process, she HAD a conflict of interest with father, she NEGLECTED the safety of child, and Nicole failed to help the mother who was asking for help, by discriminating mother, by using her power of authority for personal gain to be close to the child’s father.
June 1st mother moved into apartment, provided clean UAs, and objected to the immediate danger order.
On the 17th of June, mother walked into the courtroom with an attorney and her mother (grandma), with only a hr, and father only having Nicole to testify against mother. The hearing finished on June 19th, and finally Nicole just finished and finalized the assessment reporting it as FOUNDED.
Without providing the mothers proof of sobriety, And 5 testimonies (including mothers). The court ruled in favor of the Mother, and was reunited with her daughter that day.
Mother has put a complaint in with the Oregon governors advocacy office and yet to hear back.
Mother ALSO has yet to receive the paperwork in certified mail regarding the allegations of the FOUNDING.
Two days later (Sunday, 21 Father’s Day) mother is informed by another strange call asking for father and regarding her drug use.
Another assessment has been opened until further notice.
