Child Declared Missing in a Court of Law
I’m a 40 year old loving father of three daughters. I’ve worked as a public servant for 3 years. I was in the IT field for 20 years.
Throughout my life I always played by the rules. I’ve always been a law abiding citizen. Unfortunately due to recent events. I’ve been criminalized without conviction. Slandered and discriminated against without being charged with a crime.
To the best of my knowledge this is the timeline of events.
On or about March 22nd, 2019 at 6pm. My happy, go lucky, loving, caring daughter, (11 years old) and her friend (11 Years old). Spent the night at their friend’s house for a slumber party. This was the last time I said goodbye to my girl as I knew her. As she would come back the next day a complete stranger.
A few hours later, March 23rd 2019 12:30am. CPS Jessie Smith knocked at my door with two officers behind her. At first, I did not know who was at my doorstep. After I opened the screen door to see who was on the porch. CPS Jessie Smith walked into the house as if invited, two police officers followed suit. CPS Jessie Smith said that earlier, my daughter made a statement against me. Being the alleged perpetrator of touching her inappropriately.
After the medical forms were signed. I was trying to find a safe place for my daughter to stay. While this whole thing was investigated. But CPS deliberately denied my daughter to be put with friends and family to be in a safe place. They were trying to find a reason to put her in foster care.
On or about March 28th I went into the police station with my friend for my interview. After providing a statement of what happened I was told I was free to go.
Prior to me being the caretaker of my daughter. She was staying with her mother and mother’s ex-boyfriend who constantly abused my daughter. Her mother dropped my daughter off with me. And said “She is safer with you”. With signed parental abandonment forms notarized in front of witnesses, then left to be with her new family. March 17th 2019. She committed Parental Abandonment with a signed confession and notarized intent of abandonment with multiple witnesses. A male CPS officer from the state of Missouri showed up a week later. And said “Do not give your daughter back to her mother”. The male CPS told me that there is an open case against the mother and ex-boyfriend.
On or about May 18th, 2019 after 3 full weeks. I was finally able to get in touch with CPS Jessie Smith. And was told that my daughter can’t come home. That this investigation could take a very long time because I am being “very uncooperative”, and not answering their questions.
I tried to explain the situation about my daughter’s previous documented abuse. Her mother, and her mother’s ex-boyfriend, previous counseling, and the big sister program in which she was involved in. I tried to explain that under the care of her mother, my daughter ran away from home. And when the police in that state found her and were bringing her home. My daughter stated to the police that she’s coming to live with me. After staying on the phone for a few more minutes. CPS Jessie Smith becomes more hostile. And tells me that “You need to come into the police and take a lie detector test”. After this conversation ended there were no further contacts, notices, mails, calls or anything.
Throughout this time. There was no paperwork, no court orders, no termination of parental rights, no due rights, no judicial oversight, nothing. Myself and my daughter’s constitutional and civil rights have been violated.
90 Days were up. My Lawyer advised me on the 95th day to bring my child home. I should have gotten their disposition by then.
The documented abuser (daughters mother) is at the school. Was defended by police, the principal, and the receptionist. Who were screaming at me in front of everyone. In the front hallway to the offices saying that I was a criminal and had no right to be there. The officer tells me he needs paperwork for me to take my child out of the school. Yet the documented abuser who lives two states away. With no paperwork or documentation in hand has more rights than me?
I leave, consult my lawyer, get my paperwork and go back to the school to find that everyone has gone. I’m standing left looking stupid in an empty hallway. She essentially kidnapped her and ever since that day I have not heard anything or seen my daughter.
After my daughter was kidnapped from me. I received a notice for a 4 year restraining order in a different state, the state of Wisconsin. Was given 5 days to make a 3 day trip in order to contest it. I sent a defense via fax.
Two weeks later I get the nastiest charges imaginable against me. Allegations were made against me from another state. “The Silver Bullet” was shot. I was facing 25 years to life in prison. It took a year to clear my name in which all charges were dismissed. Prayer and the Truth prevailed. The mother did what she did 3 years ago. She ran from another investigation.
The only person that investigated anything. Per the dozens possibly hundreds of people who were interviewed was my defense council’s Investigators. It was found that a dozen others testified on my behalf. That didn’t even know who I was. And have never met me that collaborated my story, my documentation, everything I’ve been saying.
The only thing that’s changed is that my daughter is missing in a court of law. And I’ve been spoken ill of. I even had to pick the noose hanging from the branch of my tree down. And pick up the rubble of which was once my mailbox. I’ve received multiple death threats, threats of dismemberment, and public mutilation. I want those that failed their positions held responsible. I want my child brought back to me. As it stands now my child is missing and the police are unable to locate her.
Shawn DeVault Circuit Manager and Jessie Smith Caseworker both stated I am a criminal and they will find a crime to charge me.
There is an investigator currently investigating the disappearance of my daughter on a national level. God willing I will one day reunite with my daughter. And be able to tell her again how much I love her.
