<p>At the end of August 2018 DCYF of Washington state, came to my house and told me they got a call and they had a concern I was taking my son to the doctor too much. “They told me not to expect anything to happen. That they like to close these cases out in 60 days.”</p>



<p>At the End of October 2018, I took my son to the local ER cause he was puking what appeared to be blood. They transferred him to Randell children’s hospital in Portland, OR. After two days they told me they wanted to have a meeting with me about my son&#8217;s care. As I walked into the room there were several people sitting around a table. They proceeded to say that they had a pick up an order for my son to be taken into state care. They never showed me a pick-up order and bullied me saying I had a mental disorder and I was a danger to my child’s health and well-being. They said that a doctor by the name of<strong><em> Thomas J Valvano of CARES northwest</em></strong> was the person who looked through my son’s medical records and determined I had a factious disorder by proxy. I was escorted out of the hospital by an officer.</p>



<blockquote class="wp-block-quote is-style-default"><p><strong><em>DCYF of Washington state Jessica Zinger threatened me over the phone and stated that “if I didn’t admit to what I did and got the help that I wouldn’t be able to see my kids” </em></strong></p></blockquote>



<p>I told them how can I admit to something that I didn’t do. It would be lying. I got a new caseworker <strong><em>Janeane Ladigus</em></strong> and she proceeded to keep me from seeing my kids for a month and I had to get a court order to see my kids. On the first visit after a month, I saw two of my three kids. They stated that my youngest was in the ER at the time of the visit for a rash. Found out later that he was in fact not in the ER at the time of the visit and was discharged well before the time of the visit.</p>



<blockquote class="wp-block-quote is-style-default"><p> <strong><em>My baby started to show up to visits with bruises and I reported to the caseworker Janeane Ladigus and she stated not to worry about it cause he was moved to a different foster home.</em></strong></p></blockquote>



<p> He continued to show up with bruises, deep scratches, and a black eye nothing was done about this. So I <em>went back to court</em> to get my kids with family placement and it was approved and my son&#8217;s bruises had gone away and no more appeared. I had to keep taking DCYF back to court for visitation cause they absolutely refused to give me any more time or go to sporting events my kids were involved in as well as school events.</p>



<p>For the past two years and two months, I have not had fact-finding in Washington. They kept pushing it out<strong><em> “for a good reason”</em></strong>. Eventually, they stopped scheduling fact findings and there still isn’t one scheduled. If they had enough to take my kids from me then why not prove it in fact-finding instead of not ever having one.</p>



<p>I met my boyfriend shortly after the DCYF case started in 2018. I went out to Indiana to visit him in 2019 then found out I was pregnant with his child. I made the decision to move to Indiana in order to protect my unborn baby from Washington DCYF. One day I was home with my boyfriend’s older daughter and I took her to the park with some friends. A week later DCS of Clay County Indiana was knocking on my door. We set up a meeting with Michelle Puckett who was the intake caseworker. Someone called DCS cause I was at the park with my boyfriend&#8217;s older daughter, she then proceeded to say that there was an outtake case from Washington state. I was open and honest about it and she said I wouldn’t expect anything to come of this. We didn’t hear from them again.</p>



<p>July 16, 2020. Baby girl was born. Healthy and happy we went home. July 20, 2020, they came in and tore our new family apart. </p>



<p><strong><em>They Took my newborn out of her loving healthy home based on hearsay from Washington states DCYF. </em></strong></p>



<p>At the detention hearing a couple of days later they forced me to stop nursing and breastfeeding my newborn. said they wanted to test the breastmilk cause there was ipecac in the home. There was not nor will there ever be ipecac in my house. </p>



<p><strong><em>They still can’t show me actual proof that there was ipecac in either of the houses I’ve lived in.</em></strong></p>



<p> I’ve had two mental evaluations that show I do not have factious disorder by proxy and they want me to have another. I’ve had one per their referral and they just pushed it aside cause it’s not what they want it to say. I had another per me and it agrees with the one I had per them.</p>



<p>After five months of suffering for our new family. We’ve missed all her firsts. First holidays, first smile, first tooth, first milestones, and they&#8217;re STILL hasn’t been a fact-finding. DCS in Clay County Indiana keeps pushing it out. Still, to this day there isn’t one scheduled in either Washington state or Indiana. If they had enough to take my newborn why would they keep pushing out fact findings?</p>



<blockquote class="wp-block-quote is-style-default"><p><strong><em>They also NEVER wanted to look at anything I have that goes directly against what this doctor is saying. I have video and photographic evidence as well as Negative mental evaluations they ignored. We’ve recently found out this said doctor that diagnosed me with the factious disorder by proxy can’t make a mental disorder diagnosis as he’s just a general pediatrician who doesn’t have a license in mental health in adults</em></strong>.</p></blockquote>

<p>My beautiful son was taken 36 hours after he was born from his mother&#8217;s arms. I was not allowed to be in the room or even say goodbye to my little boy.. because of a rouge DCF officer, we lost our baby and we are putting up as big of a fight as we possibly can.  We don’t know what to do because they left us with little to no options. They kidnapped our child with no court order and placed him in emergency custody. We can’t comprehend how this was allowed. They kept me from even seeing him one more time and saying goodbye. I was not given any paperwork in regards to what was happening or why it was happening. Our hearts are broken for our baby boy.</p>



<p>We arrived at the hospital in the middle of a snowstorm; the biggest one this winter. Mom and I love our children so much and seeing her hurting and in pain is so difficult. Her breasts are constantly making milk for the baby, and the hospital won’t even allow us to bring the baby any breast milk. We’re being stripped of our rights as parents, the director refused to give me his name and refused to give me any paperwork, and had me escorted out and kicked off the hospital property, I was never threatening or aggressive but I was emotional and crying because of what had happened. They literally ripped my heart from my chest. </p>

<p>The DCF worker is a former caseworker from a past case with mom&#8217;s 2 other children (she had signed her rights away through an Open Adoption and has a great relationship with the adopted parents. The case was closed on Dec 6th, 2020. My son was born on Dec 17th, 2020.  Despite the case being already closed for 11 days, mom&#8217;s old worker Christine Niven had begun calling, texting, and harassing her for information and doing everything she could to use fear tactics to get more information. Including using her 2 other children and her visits as leverage as an intimidation tactic EVERY TIME. We have most things recorded, including every conversation we have had with them along with videos from the day they took our son. We don’t even live within the same area as the office she operates from, if she had had a DCF worker, it would be out of the office of the city we reside in. But that’s not the case. She has called the mother of my child “easy” because she has kids who have different fathers. <strong><em>She has laughed at successful people in my family saying things like “ yeah well most successful people are drug addicts so yours probably are”</em></strong> on recorded videos through zoom meetings. She has lied and targeted us whenever we speak up and question anything she has to say or bring to us.  </p>



<blockquote class="wp-block-quote is-style-large"><p><strong><em>She has never once given us answers to ANY questions.</em></strong></p></blockquote>



<p> The reports against her seem to go absolutely nowhere. We just want our baby, I have another daughter and I was granted rights and visits and partial custody of her, they won’t even speak to us about why we can’t see our child or even call to check on his well being.  It&#8217;s just not fair.</p>



<p>We are not bad parents. We planned for this child. We both work and have our own place, a 4 bedroom apartment for our children. We now stay up all night every night almost in tears over this and our days are filled with a sense of no purpose other than to work on whatever we can to get him home. My baby deserves to feel his mother&#8217;s warmth and look into our eyes and know his parents. Not held up because a DCF worker holds a grudge and goes against policy to steal our child.</p>

<p>It started with our daughter Holly in Albuquerque, New Mexico. We had come home after her surgery in May 2011 and an hour after us being home, 8 officers from <strong><em>Bexar County Sheriff&#8217;s Office </em></strong>showed up and asked my husband, then boyfriend at the time, to <strong><em>come outside with his hands up.</em></strong> Another officer told me to go get my daughter&#8217;s clothes and diaper bag, bottles, and formula and to bring her car seat. We did as we were told. </p>



<p>We had no idea that <strong><em>The University of New Mexico Hospital</em></strong> had reported a Subdural Hematoma found during the MRI required for the surgery to The Children Youth and Families Department and BCSO. Holly was placed on a 48-hour hold and we didn&#8217;t get her back until my partner&#8217;s aunt stepped in to care for Holly. We<strong><em> signed a safety plan</em></strong> where it said my mother in law, brother in law, and stepson were not allowed around Holly.</p>



<p> We were asked to move to a suitable residence after my husband&#8217;s landlord/aunt refused to fix plumbing. We moved and found a nice apartment. I believe the case was closed in January 2013. </p>



<p>I asked for a different Service Coordinator because the one I had was on vacation a lot and difficult to keep in contact with.  Apparently, <strong><em>it was illegal for me to ask for a different Service Coordinator</em></strong> and I was reported for making such a request. </p>



<blockquote class="wp-block-quote is-style-large"><p><strong><em>As the years passed we got reported for almost everything related to Holly&#8217;s care.</em></strong> </p></blockquote>



<p class="has-normal-font-size">I was <strong><em>reported for helping a nurse take Holly&#8217;s temperature</em></strong> at the doctor&#8217;s office. I was for cited <strong><em>sexual abuse and Missing And Exploited Children was called to come to check on Holly.</em></strong>  Holly has<strong> Autism</strong> and was non-verbal at the time. I was reported for giving Holly a drink of water and her choking on water. I was reported for not showing up for an appointment that was in our home. Someone who was supposed to be taking care of Holly through Respite Care reported us because she had to feed Holly and didn&#8217;t want to look for food. </p>



<blockquote class="wp-block-quote is-style-large"><p><strong><em>What kind of caregiver gets a job but doesn&#8217;t like watching children and is on her phone the whole time?</em></strong></p></blockquote>



<p class="has-normal-font-size"> Yes, we left Holly&#8217;s caregiver with her but if she didn&#8217;t want to watch Holly she could have said, take your baby with you, and not accepted the job. I had suggested to my husband that we take both our children Esmeralda and Holly with us but he didn&#8217;t want to wake them. Holly ran away to the park in 2015 and we were again reported for that even though my husband found Holly and brought her home safe. We were reported by Etheline Jose, SLP, and her report is false because she wasn&#8217;t with us at our home on Esmeralda&#8217;s 2nd Birthday as she claimed.</p>



<p>On April 18, 2016, we went to an FCM (Family-Centered Meeting) at CYFD on San Mateo Blvd in Albuquerque, NM. I tried warning my husband that it was best to leave the state instead of meeting with him but he insisted that they were there to help. I told him how I was a foster child and how they don&#8217;t help Families but he refused to listen to me.  Jamie Blount a Senior Investigator with CYFD and his Supervisor Tracy Hollingworth both used tactics to cause us to appear unstable to remove our kids.  Jamie Blount filed an Affidavit of False Allegations on me and my husband. Holly was pulled from me like I was a predator. She was crying and hitting herself. They used the fact that Holly played and got dirty at school to say that she wasn not properly cared for in our home.</p>



<p>The case has been open for 1,692 days as of today. My mother in law died trying to make us believe she would agree to a Guardianship. I lost years of memories by having to remove my Facebook and Twitter Accounts because of a Restraining Order CYFD filed where they lied about me. I found the Title IVE lies that are holding back the Guardianship. We recently got Educational Decisionmaker Rights but no Visitation to participate in our childrens education. I exposed CYFD to get my girls placed with my mother in law on June 13, 2019. I have a Change.org Petition still up and have sent alot of my evidence to the Department of Justice and Civil Rights Division and US Department of Education.</p>

Monica Griego completed Domestic Violence/Anger Management &amp; Parenting Classes on 8/5/2018 through Dragonfly Counseling Associates. She found the agency on her own. It was not referred by The Department. Elizabeth Ewins, LPCC wrote a letter to verify this.<br>12. Monica Griego has been working with Independent Living Resource Center Since May 2017, she was removed from ABA Training in June 2017. Sue Haugen wrote a letter to verify that The Department never referred to Monica &amp; Mark Griego to their agency. Mark Griego will be filling out an intake form on 2/11/2019 with Kate Bennett.<br>13. Monica Griego completed 1 credit hour of Continuing Education on the topic of Activities of Daily Living on 12/17/2018</p>



<p>The caseworker Amanda Veracka is no longer working with our family on the treatment plan and has not since May 11, 2018, when we stopped receiving updates from the foster parents after they threatened by email to move the children which actually never happened. Upon return from leave, the caseworker never attempted to meet with either parent, whether together or separate, and has repeatedly accused us of missing meetings. The caseworker was finally removed from the case due to her conduct with our family.</p>



<p><br>We respectfully petition this court to respect the rights of parents to parent their own children per Troxel v. Granville. The Court should act to terminate parental rights only in cases where a “reasonable person” would agree that circumstances are sufficiently dire. The burden of proof is clearly on the State to show “clear and convincing evidence” of such extreme danger. Thus far, the state has not provided such evidence.  We the parents of Holly and Esmerelda assert that no compelling circumstances exist and such accusations and charges are highly exaggerated or completely false.</p>



<p><br>1. First extreme accusation is: Jamie Blount mentioned in his Affidavit “all of the walls had been scribbled on” That is untrue. Holly’s bedroom had scribblings on them and they were painted upon us moving from the apartment.</p>



<p>2. Second extreme accusation is: Jamie Blount mentioned in his Affidavit “Mrs. Griego was discussing that multiple family members that sexually abused her” That is untrue. Jamie Blount never listened to anything I said. I had stated that my Uncle Alfred E. Gutierrez sexually abused me as a child and attempted it again when I was 14,.  This caused me to leave my mother’s home.  When we got one again after being homeless I moved into my Paternal Grandmother’s home to finish high school.</p>



<p>3. Third extreme allegation is: Jamie Blount stated in his Affidavit “Mrs. Griego didn’t know the name of Holly’s Caregiver” That is untrue. I had her first and last name which is Clara Castro on my phone and called her, she was in the process of getting licensed through The Bair Foundation and requested Holly be placed under Treatment Foster Care and The Department refused to place Holly with her, and didn’t check on her background. I have frequently communicated with Clara from 2016 until the present. She has never heard from The Department regarding Holly.</p>



<p>4. Fourth extreme allegation is: Jamie Blount stated in his Affidavit “Mr. &amp; Mrs. Griego were unable to locate a safety monitor for the children” That is untrue. We gave The Department the information. They refused to use it accurately and honestly to find a safety monitor.</p>



<p>5. Fifth extreme allegation is: Jamie Blount stated in his Affidavit “Mrs. Griego refuses to work with service providers” That is untrue. the Service Provider at Agave was working with me at the time my children were removed.</p>



<p>6. Sixth extreme allegation is: Jamie Blount stated in his Affidavit “Mrs. Griego is obsessed with the uncle that shook Holly.” That is untrue. Concerned for the children DAVID A GRIEGO continues to be around. He has a relationship with JEANNIE REQUA and her relatives have children. Correction: Dr. King accused Monica Griego of Shaking Holly as an Infant in her Neuropsychological Evaluation. He failed to listen to Monica Griego mention that David Griego admitted to shaking Holly after the BCSO Investigation ended, and the case was closed. Dr. King did not appear in court for the ADA Motion and expected Counsel Nita C. Day to use the Neuropsych Evaluation which had a lot of typos and opinions, not facts. </p>



<p>Dr. Alexander also didn’t appear at this court hearing and also expected his evaluation to be used. The Department didn’t uphold either recommendation and therefore without those recommendations, the children should have been returned. The doctors have CYFD Contracted Not Independent Practicing Doctors which makes their Evaluations written based upon Allegations that The Department received with most being falsely exaggerated or made up. Amanda Veracka spoke with Dr. Alexander and asked him to write a specific list of recommendations for Monica Griego, although Amanda Veracka will lie under oath and claim she doesn’t recall this, Monica certainly recalls it because Amanda went into Dr. Alexander’s office while Monica waited outside. Amanda took Monica to the appointment in a state vehicle and Amanda smoked outside before getting back in the state vehicle with Monica to take her back to The Department’s Lamberton Office.</p>



<p>7. MARK GRIEGO is correct in stating that “WE PARENTS” only put the girls in their room for naps and at bedtime. We never locked them in their room as any kind of punishment, and frequently checked on the children. The doorknob now in the children’s bedroom is a closet door that cannot be locked from the inside or outside of the door.</p>



<p>8. MARK GRIEGO is correct in stating that ESMERALDA GRIEGO never placed a cockroach in her mouth. The cockroach issue was overexaggerated by Jamie Blount.</p>



<p>9. MONICA GRIEGO responded as she did because she was asleep when The Department showed up. The mother worked the night shift at The Cheesecake Factory.</p>



<p>10. The children. HOLLY GRIEGO AND ESMERALDA GRIEGO were not kept within confines such as limited to a particular location confined as stated in Ex-Parte Custody Order. This family requested assistance many times from The Department each time a report was made with their requests going unheard by The Department as it has been in the past two years.</p>



<p><br>11. MONICA GRIEGO AND HOLLY GRIEGO have been the targets in this case. Holly and Monica’s disabilities have been used against them.<br>The parents seek Immediate Dismissal of this case and the Children be Immediately returned to their Parents.</p>



<p><br>II. Holly completed Early Intervention Services with YDI , Inspirations, PB and J Family Services, and Liferoots. Liferoots Team upon exiting services with Holly attended a UNM CDD Appointment with MONICA GRIEGO AND MARK GRIEGO.</p>



<p>Holly attended Early Intervention Services from 12/26/2011 until 12/09/2013 that Holly entered an Autism Specific Preschool at Mark Twain Elementary School. Esmeralda began attending La Madrugada Early Intervention Program, along with Liferoots beginning 2 months of age, and completed the PB and J Family Services Program before and while in Foster Care with her parents, MONICA GRIEGO AND MARK GRIEGO present.</p>



<p>ESMERALDA GRIEGO was receiving Early Intervention Services with PB and J Family Services and Liferoots upon removal from the home. The Parents, MONICA GRIEGO AND MARK GRIEGO both enrolled their children in these services and sought them without referrals from The Department before The Department removed the children from their care.</p>



<p>The parents, the mother especially have advocated tirelessly and persistently for HOLLY GRIEGO AND ESMERALDA GRIEGO, their disabilities, needed services and to date, the family has been continuously denied services by The Department, despite all efforts mother has made.</p>



<p>To date, no reasonable Efforts have been made by The Department to Reunify the children HOLLY GRIEGO AND ESMERALDA GRIEGO with their parents despite many requests and behaviors of the children wanting to return home. The Children’s requests are being ignored by The Department. Holly shows wanting to return home by her behaviors that The Department fails to pick up on her cues of communication. Esmeralda has said on the Friday visit before Thanksgiving 2018 “Mama, I want to go to your house and have turkey” I’m not going to Donna’s house, I’m going to your house” I told Esmeralda, “I wish with all my heart you could come to my house, Instead let&#8217;s sing a song” Esmeralda’s requests get more frequent. She insists on coming home. The Parenting Coach should be reporting this to the courts. I am aware that The Parenting Coach has participated in lying with the Social Worker Amanda Veracka to support Amanda’s false allegations about the behaviors of the mother. Despite all the mother has been through with The Department damaging her, she has continued to respect them as human beings.</p>



<p><br>A. The mother MONICA GRIEGO realized the dangers to her children, She attempted many times to communicate to The Department in person that she needed ABA Services for HOLLY GRIEGO. ESMERALDA GRIEGO had not been evaluated yet for Autism. The Department gave the children these services only after they were in foster care and never gave them to the parents so that they could adequately parent their children, to avoid a need for foster care. The Department gave the Mother MONICA GRIEGO 11 Months of ABA Therapy Sessions while the children are in custody, and has reintegrated the Father MARK GRIEGO into ABA Therapy for the children in August 2018, In that same month removing some of his therapy time with Esmeralda and transferring her sessions to daycare and the foster home due to the report he made to his attorney Susan Burgess Farrell about Esmeralda being locked in a state vehicle in August 2018 when the caseworker Amanda Veracka was on leave, forcing other employees at The Department to take responsibility of HOLLY GRIEGO AND ESMERALDA GRIEGO’S ABA Therapy Sessions including transporting the children to and from the sessions when APN Staff could not do it. </p>



<p>The Mother MONICA GRIEGO remains unable to attend the ABA Therapy despite all her attempts and the ABA agreement was not being upheld by The Department or AST RBT Christine Montoya who had the parents present, but not allowed to engage in two weeks of sessions in the month of June due to the Mother reporting Holly’s bruises and scratches on her leg to Harry Montoya Constituent Affairs Liaison which did nothing to address any issues regarding the children, and instead, the parents get punished. The Department had Christine Montoya test the parent&#8217;s anger issues as The Department does several times with other client’s cases. No therapist should participate in unethical activities which means being held accountable for the social worker&#8217;s cellphone after the social worker has clocked out of work and went home. Christine also participated in Parental Alienation of the children by repeatedly telling the parents in the sessions, “Do not coddle Esmeralda” This therapist has no children of her own therefore has no sympathy for the Psychological Damage the parents have faced by The Department.</p>



<p>B. At the FCM Meeting on April 18, 2016, the parents were under extreme fear when Tracy Hollingworth decided to create a dramatic situation out of the rod iron on HOLLY GRIEGO AND ESMERALDA GRIEGO’s bedroom windows many times interrupting Whitney Andrews, Holly&#8217;s preschool teacher who understood the dangers children with an Autism disability face if a home is without locks, door alarms, or window locks including possible drowning or elopement. This teacher was not defending the parents but was defending her student, the student’s disability, safety, and knowledge of the disability because she worked closely with Holly. The teacher realized the trauma of Foster Care would affect Holly for the rest of her life and promoting ways of intervention and assistance, not removal. HOLLY GRIEGO has been affected severely and has been the target of this case continuing due to her being a Shaken Baby Syndrome Survivor.</p>



<p>C. It is necessary for the safety and well being of the children that they return to their parents, and the Return to Custody Paperwork began Immediately.</p>



<p>D. The Parents, specifically, Monica Griego has reported to the Office of the Inspector General of Social Security Administration the Fraud that has happened in this case in regards to the children, HOLLY GRIEGO AND ESMERALDA GRIEGO due to Social Security stating that the payment of $187.00 and $1,668.13 was sent because they believed the children were home and it was a CYFD mix-up that was never explained, the only explanation is fraud due to foster caregiver wanting more money for caring for disabled children.</p>



<p><br>E. Foster Caregiver reported on AST (Autism Spectrum Therapies) Clinical Review Form that Holly was kept in a pack and play at all times while at home, and Esmeralda was kept in a crib at all times. These are both FALSE ALLEGATIONS. Also reported that Holly and Esmeralda were made to watch Frozen repeatedly for most of their life. ANOTHER FALSE ALLEGATION. The Foster caregiver does not understand Autism and was not trained for handling behaviors that Autistic children have or what triggers them and accused someone of sexually abusing Holly. ANOTHER FALSE ALLEGATION. The Foster caregiver reported that Holly was very dirty and had bedbugs. Another FALSE ALLEGATION. The apartment had bedbugs on the beds, We contacted The City of Albuquerque to tell us how to get rid of the bedbug issue, they came to our apartment with masks and protective gear on and investigated the apartment and we followed their instructions and have NO BEDBUGS since May 17, 2017. Holly was removed from school on April 18, 2016, and always played at school and came home messy, Holly likes to play in sand and dirt. Bedbugs are in motels, and almost all over Albuquerque due to people placing their furniture on the streets.</p>



<p><br>F. Recommendations from Behavioral Health Works mentioned that: Direct services are recommended to take place either in the home or a clinic-based environment. We feel that the foster caregiver and her family did not like that ABA for Holly and Esmeralda would be mostly in the home as many ABA Agencies will recommend it, due to the children learning first in the home setting. AST (Autism Spectrum Therapies) also recommended ABA Therapy in the home setting for Holly and Esmeralda on their assessments done for both girls. This is another reason for Reunification. ABA Therapy Services can re-start in the Griego Family Apartment upon the return of the children and we have enough evidence to strongly prove that Foster Care is not the place for Holly and Esmeralda due to the statements the Foster Caregiver made in two of her emails.</p>



<p><br>G. Here is what the foster mom stated in an email in November 2017:<br>&#8220;As you can see both girls are doing well. They are busy with school and ABA. Not much time for them to play and be &#8216;normal&#8217;. ABA has been good for the girls. Unfortunately, the other kids in our home have been neglected because of ABA. My daughter does enjoy gymnastics twice a week because you (Amanda) are awesome and amazing to have the ABA services in your office. But she (my daughter) and my 6-year-old twins are unable to do after-school activities &#8211; chess club, drama club, etc. I am trying to be patient. My kids are great about it. BUT it is a lot! I know &#8216;all I have to do is be at home all those hours&#8230;seems great! It’s the stress of making sure I pick up everyone after school in time to be home for ABA. It&#8217;s the stress of having to pay for aftercare for my daughter on Wednesdays&#8230;I am committed to continuing ABA until the girls either go home or a TPR happens. I am not complaining&#8230;this is a lot of tho&#8217;. The other kids here are just as important and have needs too.&#8221; This was the second complaint from the foster caregiver. </p>



<p>The first complaint was sent to Previous GAL Steve Mazer who did nothing about the Foster caregiver complaining. In the last hearing where he was present he seemed to realize that we are good parents who made mistakes, but then did a 360 degree turn and was in favor again with The Department despite him being aware of Holly being restrained at CYFD even when Holly didn’t display self-injurious behaviors, I also notified John Duran, my first counsel of Christine squeezing Holly’s jaw to force her to speak and that was the second time I became very concerned that this Registered Behavior Technician doesn’t have the qualifications to work with my daughter if she can do that to her in session using books to cover the observation glass citing that Holly got distracted, which wasn’t always true. I brought this up with Amanda Veracka and she never seemed to care as it wasn’t her child having their jaw squeezed.</p>

<p><br>The state worker&#8217;s name involved in said criminal activity is Victoria Sena, Alysandra Newbill.</p>



<p><br>&nbsp;That individuals supervisor through said agency of State of New Mexico, Children Youth and Families Department, located at the address of:4501 Indian School Rd NE, Albuquerque, NM 87110&nbsp;In the State of New Mexico.<br>In the County of Bernalillo, the supervisor&#8217;s name being, Megan Gonzales.&nbsp;<br>The laws and criminal activity involved are of the following starting with Misappropriation of state funds of the state of New Mexico, Children Youth and Families Department.&nbsp;</p>



<p><br>Funds being misappropriated by this worker are fund applied to court cost in the following court case/cases being JQ-2016-0076, held at the following court Second District Children&#8217;s Court, at the address of 5100 2nd Street NW, in the state of New Mexico.&nbsp;</p>



<p><br>I, the parent of Holly M.Griego and Esmeralda R.Griego, have been accused of neglect and Inadequate Shelter.&nbsp;<br>There haven’t been any final rulings on said allegations so by proceeding with said case this is misappropriation of state and county resources being the local justice system and courts.&nbsp;</p>

<p>In October 2000, Neelu Chaudhari Berry’s baby niece died in a Northeast London hospital under highly suspicious circumstances. Having been repeatedly given an adult dose of medication, the baby’s mother — Neelu’s sister — found her dead baby in the hospital morgue, her body mutilated and all of her organs, including her eyes, removed. Neelu’s shocking testimony speaks to the alarming levels of systemic abuse, corruption and cover-ups that go on within the health and justice systems in the UK</p>

<p>The Bryants’ son was one of 4,772 Colorado children removed from their homes by child welfare authorities and living in foster care last year. But their story isn’t the typical tale of a child rescued from abuse or neglect.</p>



<p><strong>FOUNTAIN</strong>&nbsp;— When a child protection caseworker told Crystal Bryant they were taking her 5-month-old boy, the young mother dropped to her knees on the hospital floor.&nbsp;</p>



<p>“Take me,” she pleaded. “For my son to stay home, take me, I don’t care.”&nbsp;</p>



<p>She begged God and anyone listening, but “they still took him,” Bryant recalled, shaking her head and wiping tears as she recounted the worst moment of her life. Child welfare and police officers made Bryant and her husband, Jarvis Bryant, leave the Colorado Springs hospital room before a foster mother arrived to take their baby away.&nbsp;</p>



<p>Their lives were shattered.&nbsp;</p>



<p>The Bryants, who moved to Fountain when Jarvis was assigned to Fort Carson, were charged with felony child abuse, accused of breaking multiple bones in their only child’s body. Crystal’s recently earned nursing certificate was revoked. Jarvis, a U.S. Army specialist, lost his security clearance, stripping him of his job in aircraft and vehicle supply and relegating him to paper shuffling.</p>



<p>Worst of all, baby Jace was gone. Their apartment seemed empty. They felt powerless, more than lost — “like death,” Crystal said.&nbsp;</p>



<p>The Bryants’ son was one of 4,772 Colorado children removed from their homes by child welfare authorities and living in foster care last year. But their story isn’t the typical tale of a child rescued from abuse or neglect. It’s the opposite. The Bryants’ nightmare lasted 164 days, and its end arrived more like a ripped-from-the-headlines television drama than real life.&nbsp;</p>

<p>Baby Jace had been sick his whole life. He had severe acid reflux and a swallowing condition called dysphagia that caused milk to go down his windpipe instead of his esophagus, making him choke.&nbsp;</p>



<p>When he was 3 weeks old, he spent 31 days in the hospital and had a feeding tube inserted into his nose and down to his stomach to help him get enough nutrients to survive. At almost 4 months old, Jace had surgery on his esophagus and to place a gastrostomy tube in his abdomen, so his parents could send formula straight to his stomach.</p>



<p>Then, just before Thanksgiving 2018, Jace was diagnosed with a viral infection that was causing fever and diarrhea. While Crystal showered and did her hair upstairs in their apartment, Jarvis was giving Jace his second bath of the day. Jarvis laid the baby stomach-down along his forearm as he bent over the bathtub, pouring soapy water over Jace’s back. The baby slipped sideways off Jarvis’ arm, his knee hitting the bottom of the tub.&nbsp;</p>



<p>Jace cried, and Jarvis picked him up to console him, he said. Jarvis said he was leaning into the tub when the baby fell into a small amount of water, “enough to make a toy float.” Jarvis didn’t mention it to his wife.</p>

<p>Later that Sunday afternoon, though, Crystal noticed Jace was favoring his leg, that he held it up as he sat in his vibrating saucer-chair and flinched when she picked him up. She was bringing him back to the hospital anyway because the fever and diarrhea had not subsided, and while she was there Crystal asked the doctor if they could X-ray Jace’s leg.&nbsp;&nbsp;</p>



<p>The baby had a fractured femur.</p>



<p>Crystal called Jarvis at home, and he told her then how Jace had slipped from his arm and hit his knee. As Jarvis drove to the hospital, Crystal told the doctor that her husband had dropped their son in the bathtub.&nbsp;</p>



<p>Instantly, they were suspects.&nbsp;</p>



<p>Medical staff at Memorial Hospital Central ordered a full-body workup. What they found was devastating: Not only did Jace have a broken leg, he had 10 fractured ribs and two fractured wrists. The leg fracture was fresh, but the rest were in various stages of healing.&nbsp;</p>



<p>The police came, interviewing Crystal, 24, and Jarvis, 27, in separate rooms. A caseworker arrived from the El Paso County child welfare division, and a pediatrician with training in child abuse examined Jace. A detective did “voice stress analysis tests” by recording and analyzing their voices, deciding both parents were “deceptive” — Jarvis about knowing who caused Jace’s injuries and Crystal about whether she hurt her son.</p>



<p>Jace’s medical records as well as the child abuse charging documents, both reviewed by The Colorado Sun, do not mention unexplained bruises or burns — red flags of child abuse. They do note marks on his chest, back and cheek, some of them “crescent-shaped” scratches. The Bryants told authorities one mark was a scar from his g-tube surgery and the others were likely from his parents or medical staff accidentally scratching him with fingernails or a ring while picking him up.&nbsp;</p>



<p>Because of Jace’s feeding problems, nurses, physical therapists and occupational therapists — all required by law to report any suspicion of child abuse — had been to the Bryants’ home twice each week since he was 2 months old. They had stripped Jace naked weekly and weighed him on a portable scale placed on the table. Not one made any report of abuse or neglect.&nbsp;</p>



<p>The baby had been to emergency rooms multiple times, often to replace the tube down his throat when his arms flailed and pulled out the tube, common for babies. Each time, medical staff took an X-ray to make sure it was in the right place. As a first-time mom and self-described “hovering parent,” Crystal took Jace to the pediatrician at the first hint of illness.&nbsp;&nbsp;</p>



<p>Still, three days after she brought Jace to the hospital and asked for the leg X-ray, El Paso County authorities told the Bryants he wasn’t going home with them — their home, authorities said, wasn’t safe for their son.</p>



<p>The Bryants returned to their apartment without their baby and gathered up everything they thought he might need at his foster home — toys, clothes, his medicines for acid reflux, formula, shampoo, laundry detergent, Vaseline. They had no family nearby; Crystal is from Chicago, and Jarvis is from Louisiana.</p>

<p>The following morning, a distraught Crystal dialed the child welfare division. Five times. “I am concerned. I am pissed off. I’m angry, sad, frustrated,” she said.&nbsp;</p>



<p>“It’s Thanksgiving. Can I see my son?”</p>



<p>The answer was no. Crystal sat on the couch and cried.</p>



<p>Losing their son sent Crystal into heavy depression, so dark that she once opened the passenger door in their car as Jarvis drove 80 mph down the highway away from a supervised visit with Jace. “I just wanted to jump out,” she said. “I couldn’t believe I was still living on this Earth, without my son. It was hell on Earth.</p>



<p>“There was no living for me.”</p>



<p>Crystal stopped eating and drinking and grew so ill that Jarvis drove her to Evans Hospital on Fort Carson in early January, about a month and a half after Jace was taken away. But when Jarvis handed over his military ID at the checkpoint, the guard hesitated.&nbsp;</p>



<p>“Do you know there is a warrant out for your arrest?” the guard asked, Jarvis recalled. “Did you not pay a ticket or something?”</p>



<p>There was a warrant for Crystal, too. Felony child abuse charges, in addition to the civil case to determine whether to terminate their parental rights, had been filed against them. The class 3 felony is punishable by up to 16 years in prison.&nbsp;</p>



<p>The Bryants, neither of whom have any criminal history, were handcuffed and taken in separate military police cars and held on post for an hour and a half, when city law officers transported them to the El Paso County Jail. “Mug shots. The whole orange jumpsuit. Everything,” Jarvis said. They spent the night and were able to post bond the next morning.&nbsp;</p>



<p>While Crystal slipped further into depression, Jarvis was the fire.&nbsp;</p>



<p>He contacted the ACLU and the NAACP to see if they could help with legal defense, though Jarvis and Crystal were each assigned two public attorneys for the civil and criminal cases. He spent hours reading medical records and court cases. “This is literally our lives, our son’s life, our livelihood, our well-being, our mental state, pretty much everything that we could ever think of is at stake,” he said. “I’m not going to sit here and let this happen. It’s one thing if you know you did something wrong. But if you know you didn’t do anything wrong, why are you going to go down innocent?”</p>



<p>Jarvis went to every hospital and doctor’s office that had seen Jace, beginning with his May 22, 2018, birth at Evans Hospital. He collected 1,200 pages of medical records, along with discs of all of Jace’s X-rays, including those taken before and after his surgery and tube placements.</p>



<p>They hardly slept. They fought, wondering if losing Jace would break them. They went to supervised visits at the Family Visitation Center, and signed up for individual therapy and parenting classes, trying to anticipate what the county would ask of them and speed up the process to getting their son back.</p>

<p>One sleepless night in March, Jarvis stumbled on a&nbsp;<a href="https://www.youtube.com/watch?v=FWBKoN58754">YouTube video</a>&nbsp;of TV journalist Katie Couric interviewing two families in 2013 who were wrongly accused of child abuse after their children were found with broken bones. A Texas father was arrested after his 1-month-old daughter was found with nine bone fractures. Another father was accused of abusing his twin infants after they both had leg fractures. Both were eventually cleared because the babies all had a brittle bone disorder.&nbsp;</p>



<p>The video led Jarvis to a website called&nbsp;<a href="https://www.fractured-families.org/">Fractured Families</a>, a network for parents of children with unexplained fractures. And he fired off multiple emails — titled “Can you please help my family?”&nbsp;</p>



<p>Through the network, Jarvis found contact information for more than a dozen physicians and radiologists who were experts in bone fractures and emailed all of them. “We need help from a medical professional urgently to try and fight this matter properly and get our baby back and prove our innocence,” he wrote. “It just doesn’t make any sense how a baby like ours has such a lengthy medical history and no one has done their due diligence to properly rule out everything before they automatically say child abuse. Please help us.”</p>



<p>Two doctors agreed to help, for free.</p>



<p>Dr. Susan Gootnick, a radiologist in California who began studying alleged child abuse cases about seven years ago, looked at Jace’s X-rays and noticed immediately that his bones appeared “washed out” because they weren’t getting enough calcium. It made sense, given Jace had not been able to eat by mouth for the first several months of his life. His scans were consistent with metabolic bone disease and rickets, she wrote in a report that Jarvis gave to his attorney.</p>



<p>“Obviously, the baby wasn’t getting the appropriate nutrients that he needed to grow,” Gootnick said in an interview with The Sun. “These bones break under stresses that a normal bone would not break under.”&nbsp;</p>



<p>What’s more, Gootnick said, the age of the fractures made it likely that Jace’s ribs and wrists were broken by medical staff during one of the many times they reinserted his nasal tube — unsedated. An X-ray taken in September shows the rib fractures and the tube that went from Jace’s nose to his stomach.&nbsp;</p>



<p>“It’s unpleasant, as you can imagine, sticking a tube down their nose,” Gootnick said. “You have to increase the strength of how you hold the baby still.”</p>



<p>On one of the X-rays of Jace’s wrist, Gootnick noted, an adult thumb bone is visible — the technician holding down his arm for the scan.&nbsp;</p>



<p>Another doctor, Dr. John Galaznik, a retired pediatrician in Alabama who has testified for the defense in numerous child abuse trials, zeroed in on two acid-reflux medications Jace had taken since he was 3 weeks old — Omeprazole and Ranitidine. They cut down on stomach acid, which is essential for absorbing calcium. Galaznik said it was likely that Jace’s muscles so badly needed calcium that they were leaching it from his bones.</p>



<p>He cited the baby’s elevated levels of parathyroid hormone, which the brain secretes at a higher level when the body’s calcium requirement is not met, Galaznik said.&nbsp;</p>



<p>The doctor also noted that the fractured leg bone was consistent with a “compressing force” such as the bathtub fall Jarvis described. The fracture suggested no “yanking, pulling, twisting forces as one might predict an abusing caregiver to inflict,” he wrote.&nbsp;</p>



<p>Galaznik, who for 37 years was a physician in the University of Alabama system, said in an interview that the study of bone fractures in babies has “evolved rapidly over the last 10 years,” so much so that emergency department physicians who were trained 10 or 20 years ago are often not up to date.&nbsp;</p>



<p>In 2009, the American Academy of Pediatrics&nbsp;<a href="https://www.aafp.org/afp/2009/0715/p196.html">doubled the recommended vitamin D</a>&nbsp;intake for babies, noting that vitamin D deficiency could lead to decreased calcium absorption and bone fractures. And in 2014, the academy’s&nbsp;<a href="https://pediatrics.aappublications.org/content/133/2/e477">Committee of Child Abuse and Neglect published a paper&nbsp;</a>calling attention to the difference between fractures caused by abuse and those resulting from rickets or brittle bone disease, called osteogenesis imperfecta.&nbsp;</p>

<p>Galaznik is contacted by dozens of families each year and takes on some of the cases pro bono. He and Gootnick said they have noticed a societal bias against parents who are low-income and without higher education. “If you come in and you are well-dressed and well-known and have no background problems, it may give the accusers more pause,” Galaznik said. “Just the allegation can destroy a career.”</p>



<p>Gootnick said the cases she takes on lack sufficient evidence. “There should be more investigation of what’s going on with these kids in terms of their bone health,” she said. “I feel a moral obligation to help these people. If I can help them, I have to help them.”</p>



<p>Jarvis printed out the doctors’ reports and gave them to his attorneys. And they waited.&nbsp;</p>



<p>Jace lived with the same foster family for 164 days. The Bryants counted all of them.&nbsp;</p>



<p>The baby, who was in the foster home from age 5 months to 10 months, seemed to know his parents less and less each week when they saw him for their two-hour supervised visit. “One more of those and I feel like my son wouldn’t even remember me,” Crystal said.&nbsp;</p>



<p>They tried to move Crystal’s sister from Chicago so she could become Jace’s foster mom, an arrangement the child welfare system calls a “kinship” placement. When she couldn’t come, a couple Jarvis met at work offered to help. They became Jace’s foster placement, and the Bryants were allowed to move into their house, under the condition that they were never alone with their son.&nbsp;</p>

<p>The arrangement lasted about two months, until the day last July when Jarvis and Crystal were to appear in civil court for their hearing on whether they could keep their son. Instead, the El Paso County child welfare division — which in the meantime had deposed the division’s child abuse doctor in the wake of the pro-bono expert reports — recommended they take their son home.&nbsp;</p>



<p>The Bryants, elated and relieved, took Jace home that night — seven months after he was removed from their custody.</p>



<p>Three months later, in October, the criminal charges against them were dismissed. District Judge David Gilbert ordered the case sealed during the same hearing. “It was like it happened and all of a sudden, it was wiped away,” Jarvis said.&nbsp;</p>



<p>Crystal was in disbelief. “I never would have thought in a million years that this would be our life,” she said. “I never thought this could happen to my son. But we’re still here. People would have thought we would have given up and turned on each other and Jace would stay in foster care. But I survived that. We survived that.”</p>



<p>The Bryants, who are black, believe they were victims of a racial bias that exists in the child welfare system. A&nbsp;<a href="https://www.childwelfare.gov/pubpdfs/racial_disproportionality.pdf">U.S. Department of Health and Human Services report&nbsp;</a>showed that African American children are placed in foster care at almost twice the rate of white children, and they stay in foster care longer.&nbsp;<a href="https://www.sciencedirect.com/science/article/pii/S0190740911001277">Two studies in Texas&nbsp;</a>found that even when African American families were assigned lower risk scores in child-abuse assessments, they were more likely than white families to have their children removed.&nbsp;</p>



<p>El Paso County child welfare officials declined to discuss the Bryants’ case, citing confidentiality laws. They said it is extremely rare that parents are accused of abuse and then exonerated, although they could not say how often it happens because the state child welfare data system does not keep track.&nbsp;</p>



<p>“It is exceedingly, exceedingly rare,” said Kristina Iodice, the department’s public information officer. El Paso County investigated 6,633 child abuse and neglect allegations last year. Just more than 1,753 of those were founded. On any given day in 2019, about 360 children in the county were in foster placements.</p>



<p>Before a child is removed, the case is reviewed by a team that includes supervisors and medical professionals, said April Jenkins, intake manager for the county’s Children, Youth and Families Services. A judge has to verbally approve a child’s removal, no matter what time of day or night, and child protection workers have to present written evidence for the removal in court within 72 hours.&nbsp;</p>



<p>“We are not making any decisions or assumptions or anything like that in a vacuum,” Jenkins said.&nbsp;</p>



<p>On a recent afternoon, 20-month-old Jace squealed and giggled as he crawled into a play tent in the Bryants’ living room, where photos of Jace as a baby, the Bryants in military uniform shortly after they met at basic training in Missouri, and the couple on their wedding day hang on the walls. The Bryants have a new appreciation for days when the three of them are at home together, like when Jarvis made gumbo and they watched Louisiana State University win the national college football championship against Clemson.</p>



<p>Jace is eating by mouth now, after Jarvis and Crystal slowly introduced him to foods, starting with strawberries and other soft fruits. He is growing out of neonatal rickets and his bones are becoming stronger. And his g-tube is scheduled to come out in April. Jace doesn’t seem to remember what he went through, but his parents think they will probably tell him, some day.&nbsp;</p>



<p>Crystal gave up on restoring her nursing certification — the main reason she wanted it was to take care of Jace’s g-tube. Jarvis is still waiting for the Army to restore his security clearance, and when it does the Bryants hope to leave Colorado for another Army post. The state where their baby was born has too many bad memories.&nbsp;</p>



<p>When they drive to Fort Carson, they avoid the guard station where they were arrested. When Jace was sick recently with a 104-degree fever, they hesitated before taking him to the hospital. “I’m sure as soon as you pull up his medical records, it says possible abuse, and everybody is looking at us now,” Crystal said.</p>

<p>Wherever they live, the Bryants said they won’t get over what they experienced during the past year. They’re speaking out now to help other families who are falsely accused.&nbsp;</p>



<p>“It’s no hard feelings for us, but it’s anger,” Jarvis said. “This is what we actually had to live through. This is what our son had to live through. There should be due diligence before someone’s child is removed from their care. That is like, absurd, that you can take someone’s child and get a judge to sign off on it and you didn’t even do your due diligence.”</p>



<p>The Bryants said some of those involved in their case, including at the child welfare division, apologized privately for what they had been through. For Crystal, though, nothing can make up for lost time.&nbsp;</p>



<p>“I’m still grieving those days I didn’t have my son with me,” she said. “We missed so many diaper changes, so many baths. I missed so much of his life.”</p>
